ORDINANCE NO. 990050

 

Authorizing a $435,449.00 contract with Capital Electric Construction Company, Inc., for emergency flood damage repairs at the American Royal Facility; authorizing the Director of Public Works to expend $435,449.00 in funds appropriated herein for the project; and recognizing an emergency.

 

WHEREAS, the City Council finds and determines that this ordinance to authorize an emergency contract for repairs of public arena facilities flood damaged on October 5, 1998, is necessary for the immediate preservation of public property and safety within the meaning of Article II, Section 15 of the Charter; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the work of providing emergency repairs at the American Royal Arena Facility Complex, Kansas City, Missouri, is hereby provided for and authorized.

 

Section 2. That the Director of Public Works is hereby authorized to execute an emergency technical services contract for Project No. 288-99052-1 for flood damage repairs with Capital Electric Construction Company, Inc., in the amount of $435,449.00, which contract is hereby approved and confirmed. The contract shall be essentially in the form which is attached and incorporated herein by reference.

 

Section 3. That the Director of Public Works is hereby authorized to expend the sum of $435,449.00 from funds heretofore appropriated to Account No. 99-100-089-2990-B as and for consideration in the aforementioned emergency contract.

 

Section 4. That this ordinance being for the immediate preservation of public property and safety, is hereby recognized to be an emergency measure within the provisions of Article II, Section 15 of the Charter and shall take effect immediately upon passage.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
