ORDINANCE NO. 020287

 

Approving a Community Unit Project on an approximately 13.4 acre tract of land generally located at the northwest corner of N.E. 48th Street and N.E. Randolph Road. (11796-CUP-3)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a Community Unit Project on an approximately 13.4 acre tract of land generally located at the northwest corner of N.E. 48th Street and N.E. Randolph Road, and more specifically described as follows:

 

A tract of land located in the Southeast Quarter of Section 33, Township 51 North, Range 32 West of the Fifth Principle Meridian, Kansas City, Clay County, Missouri, being more particularly described as follows: Beginning at the northwest corner of the South One-Half of the Southeast Quarter of said Southeast Quarter; thence South 89E26'52" East along the north line of the South One-Half of the Southeast Quarter of said Southeast Quarter, a distance of 1,123.64 feet to the west right of way line of I-435; thence South 34E48'11" West along said west right of way line, a distance of 207.55 feet; thence South 17E26'34" West continuing along said west right of way line, a distance of 434.57 feet; thence South 00E43'33" West continuing along said west right of way line, a distance of 6.05 feet; thence North 89E24'02" West continuing along said west right of way line, a distance of 225.08 feet; thence South 00E35'58" West continuing along said west right of way line, a distance of 12.82 feet to a point on the north right of way line of N.E. 48th Street; thence along said north right of way line, on a curve to the right, having a radius of 3,779.72 feet, an initial tangent bearing of North 85E24'27" West and an arc length of 57.74 feet; thence continuing along said north right of way line on a curve to the left, tangent to the last described course, having a radius of 2,904.79 feet and an arc distance of 602.28 feet to the east line of Greenwood, according to the recorded plat thereof; thence North 00E51'11" East along said east line, a distance of 612.31 feet to the point of beginning. Contains 583,850 square feet or 13.403 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineers Office for approval and that the developer construct any improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.


4. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

5. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

6. That the developer receive approval from the Missouri Departrment of Transportation for access onto N.E. Randolph Road.

 

7. That the developer secure the approval of the Missouri Department of Transportation prior to working within any State right of way.

 

8. That the developer secure the approval of the Board of Zoning Adjustment for all residential signs in accordance with Section 80-213(b)(11).

 

9. That the developer contribute $11,530.23 in lieu of parkland dedication for 6 single-family units and 90 multi-family units (6 single-family units x 3.7 x 0.006 = 0.13 acres + 90 multi-family units x 2 x 0.006 = 1.08 acres. 0.13 acres + 1.08 acres - 0.31 acres provided = 0.90 x $12,811.37 = $11,530.23) in satisfaction of Section 66-128 of the Subdivision Regulations.

 

10. That the developer extend sanitary sewers as required by the Department of Public Works.

 

11. That the developer extend water mains and provide easements as required by the Water Services Department.

 

12. That the developer install hard surface roads and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

13. That the developer submit a street tree planting plan as part of the final plat with a copy to be submitted to the Department of City Development, secure the approval of the City Forester for street trees planted on right of way in front of residential lots, and plant the street trees in conformance with the plan approved by the City Forester. The plan shall include size, type, species and placement of trees.

 

14. That the developer submit a final plan to the City Plan Commission for approval including plans for landscaping, screening, signage (including elevations), grading and building elevations.

 

A copy of said Community Unit Project plan is on file in the office of the City Clerk under Document No. 020287, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
