COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 900460

 

Approving an amendment to a previously approved preliminary plan in District CP-2 on a 39 acre tract of land located at the southwest corner of N.W. 64th Street (Missouri Highway 45) and I-29. (7588-CP-8)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved preliminary plan in District CP-2 on a 39 acre tract of land located at the southwest corner of N.W. 64th Street (Missouri Highway 45) and I-29, and more specifically described as follows:

 

All that part of the Northeast Quarter (NE 1/4) of Section 30 and that part of the Northwest Quarter (NW 1/4) of Section 29, including portions of North Overland Drive and N.W. 63rd Street Terrace and all of Lot 3 and parts of Lots 1, 2 and 4, LAPLATA, a subdivision, all in Township 51, Range 33, in Kansas City, Platte County, Missouri, more particularly described as follows: Commencing at the intersection of the West line of the East Half (E 1/2) of the Northwest Quarter (NW 1/4) of said Section 30 with the South right of way line of Missouri State Highway No. 45, as now established, 140 feet South of, measured at right angles from the center line of said highway; thence East along said South right of way line, 845.20 feet to a point 140 feet South of, measured at right angles, from Station 1884+00 on said center line; thence Northeasterly along said South right of way line 107.70 feet to a point 100 feet South of, measured at right angles, from Station 1885+00 on said center line; thence East along said South right of way line 1000.00 feet to a point 100 feet South of, measured at right angles from Station 1895+00 on said center line; thence Southeasterly along said South right of way line, 107.70 feet to a point 140 feet South of, measured at right angles from Station 1896+00 on said center line; thence East along said South right of way line 382.33 feet to the point of beginning of the tract of land to be herein described; thence continuing East, along the last described course, 167.67 feet to a point 140 feet South of, measured at right angles from Station 1901+50 on said center line; thence Northeasterly along said South right of way 150.75 feet to a point 125 feet South of, measured at right angles from Station 1903+00 on said centerline; thence East, along said South right of way line 850 feet to a point 125 feet South of, measured at right angles from Station 1911+50 on said center line; thence Southeasterly, along said South right of way line, 70.71 feet to a point 175 feet South of, measured at right angles from Station 1912+00 on said center line; thence East, along said South right of way line and its prolongation, 288.7 feet, more or less to a point on the East line of said Section 30, which point is 175 feet South of, measured at right angles from said center line; thence North along said East line, 60 feet; thence East 15 feet to a point on the East
line of said Lot 1, which is 115 feet South of, measured at right angles from approximate Station 1915+03 on said center line, said point being also on the Southwesterly right of way line of U.S. Interstate Route 29, as now established; thence Southeasterly along said Southwesterly right of way line, 330 feet, more or less to an intersection with the Northeasterly line of said Lot 4; thence Southeasterly, along said Northeasterly line, being also the Southwesterly right of way line of N.W. Paulane Street, 70 feet; more or less, to the Southeast corner of said Lot 4; thence West, along the South line of said Lot 4, 98.42 feet to the Northwest corner of Lot 5, in said LAPLATA; thence South, along the West line of said Lot 5 and its prolongation, across N.W. 63rd Street, as now established, 175 feet to a point on the North line of Lot 6, in said LAPLATA; thence West, along the North line of said Lot 7 and along the North line of Lot 6 in said LAPLATA, 125 feet to the Northwest corner of said Lot 6; thence South, along the West line of said Lot 6, 150 feet to the Southwest corner thereof; thence West, along the prolongation of the South line of said Lots 6 and 7, 115 feet to a point on the West line of the Northwest Quarter (NW 1/4) of said Section 29, which point is also on the East line of the Northeast Quarter (NE 1/4) of said Section 30; thence South along said East line, 460 feet; thence West, along a line which makes a Northwest angle at 9045' with the last described course, 245 feet; thence Northwesterly along a line which deflects to the right 2515' from the last described course, 215 feet; thence Northwesterly along a line which deflects to the left 1115' from the last described course, 360 feet; thence Southwesterly along a line which deflects to the left 7400' from last described course, 325 feet; thence Westerly along a line which deflects to the right 6900' from the last described course, 240 feet; thence Westerly along a line which deflects to the left 915' from the last described course, 250 feet; thence Northerly along a line which deflects to the right 9415' from the last described course, 345 feet; thence Westerly, Northwesterly and Northerly along a curve to the right from an initial tangent which deflects to the left 8600' from the last described course, having a radius of 325 feet, a distance of 393.62 feet; thence Northerly tangent to the last described curve, 140 feet, more or less, to a point on the Easterly boundary of a tract of land approved by Ordinance No. 38916 for a Community Unit Project proposed by August R. Grasis and Biruta Grasis; thence Northeasterly along said Easterly boundary to an angle point therein; thence continuing Northeasterly along said Easterly boundary, which deflects to the right 130'00" from the last described course, 198.00 feet; thence continuing Northeasterly along said Easterly boundary, which deflects to the left 800'00" from the last described course, 156.10 feet to the point of beginning.

 

is hereby approved, subject to the following condition:

 

1. That the developer submit a storm drainage study.

 

A copy of said amendment is on file in the office of the City Clerk under Document No. 900460, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
