ORDINANCE NO. 060162

 

Amending Chapter 12, Code of Ordinances, by repealing Sections 12-108, Penalty for violation of article, and 12-154, Penalty for violation of article, and enacting in lieu thereof new sections of like number and subject matter.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That Chapter 12, Code of Ordinances of the City of Kansas City, Missouri, is hereby amended by repealing Sections 12-108, Penalty for violation of article, and 12-154, Penalty for violation of article, and enacting in lieu thereof new sections of like numbers and subject matters, to read as follows:

 

Sec. 12-108. Penalty for violation of article.

 

Each violation or failure to comply with any of the provisions of sections 12-101 to 12-106 shall constitute a separate ordinance violation and shall be punished by a fine not less than $1.00 and not more than $500.00, or be punished by imprisonment in the municipal correctional institution, not to exceed six months, or be punished by both fine and imprisonment.

 

Sec. 12-154. Penalty for violation of article.

 

It shall be unlawful for any person to keep or operate a dance hall as defined in this article without having secured a license, or to violate any of the other provisions of this article. Upon conviction thereof, such person shall be punished by a fine not less than $1.00 and not more than $500.00, or be punished by imprisonment in the municipal correctional institution, not to exceed six months, or be punished by both fine and imprisonment. Each and every day that such a public dance hall or place where dancing by the public is permitted or conducted without a license shall constitute a separate offense.
