RESOLUTION NO. 010078

 

Approving an amendment to the Martin City Area Plan by modifying the Land Use Plan and Map for an area of approximately 3.43 acres generally located on the west side of Holmes Road, approximately 400 feet south of Blue Ridge Boulevard, to recommend commercial service uses instead of medium density residential uses.

 

WHEREAS, on September 8, 1988, the City Council by Resolution No. 62809 adopted the Martin City Area Plan as a guide for development and redevelopment of that area generally located between Blue Ridge Boulevard and the Jackson County-Cass County line and between U.S. Highway 71 and State Line Road; and

 

WHEREAS, said Martin City Area Plan was amended on December 8, 1994, through the adoption of Resolution No. 941538; was amended on July 3, 1997, through the adoption of Committee Substitute for Resolution No. 970815; was amended on August 28, 1997, through adoption of Committee Substitute for Resolution No. 971078; was amended on April 13, 2000, through adoption of Resolution No. 000370; and was further amended on August 24, 2000, through adoption of Resolution No. 000958; and

 

WHEREAS, after further review by the City Development Department it has been deemed appropriate to amend the Martin City Area Plan as it affects that area of approximately 3.43 acres generally located on the west side of Holmes Road, approximately 400 feet south of Blue Ridge Boulevard, by modifying the Proposed Land Use Plan and Map for such area from medium density residential uses to commercial service uses; and

 

WHEREAS, public notice of a hearing before the City Plan Commission was published on September 18, 2000; and

 

WHEREAS, the City Plan Commission considered such amendment to the Proposed Land Use Plan and Map on October 3, 2000; and

 

WHEREAS, after all interested persons were given an opportunity to present testimony, the City Plan Commission did on October 3, 2000, recommend approval of the proposed amendment to the Martin City Area Plan; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the sixth amendment to the Martin City Area Plan is hereby approved as to the Proposed Land Use Plan and Map for that area of approximately 3.43 acres generally located on the west side of Holmes Road, approximately 400 feet south of Blue Ridge Boulevard, by changing the recommended land uses for the area from medium density residential uses to commercial services uses. A copy of the amendment to the Land Use Plan and Map of the Martin City Area Plan is attached hereto as Exhibit A and incorporated herein by reference.

 

Section B. That the amendment to the Martin City Area Plan is consistent and complies with the FOCUS Kansas City Plan, adopted on October 30, 1997, by Committee Substitute for Resolution No. 971268, and is adopted as a supplement to the FOCUS Kansas City Plan.

 


Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all required public notices have been given and hearings have been held.
