Rezoning an area of approximately
6.67 acres generally located at the southeast corner of N.W. 72nd
Street and I-29 from District CPO-1 to District O, and approving a
development plan for the same. (6045-P-5)
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section A. That
Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly
known as the Zoning Ordinance, is hereby amended by enacting a new section to
be known as Section 80-11A0594, rezoning an area of approximately 6.67 acres
generally located at the southeast corner of N.W. 72nd Street and
I-29 from District CPO-1 (Administrative, Professional and Research/High
Buildings) to District O (Office), said section to read as follows:
Section 80-11A0594. That an area
legally described as:
All that part of
Tract A, LINDEN PARK MEDICAL AND PROFESSIONAL CENTER, a subdivision of land
in Kansas City, Platte County, Missouri, described as follows: Beginning at the
Southeast corner of said Tract A; thence North 00o57'09"
East, along the East line of said Tract A, 398.93 feet; thence North 06o17'21"
West, along said East line, 332.58 feet to the Northeast corner of said Tract
A; thence North 89o09'21" West, along the North line of said
Tract A, 272.43 feet; thence South 00o50'39" West, 114.00
feet; thence South 89o09'21" East, 18.00 feet; thence South 05o34'45"
East, 151.95 feet; thence North 89o09'21" West, 242.52 feet to
the most Westerly corner of said Tract A, thence South 11o21'14"
East, along the Westerly line of said Tract A, 474.65 feet, to the Southwest
corner of said Tract A; thence South 89o09'21" East, along
the South line of said Tract A, 420.20 feet to the Point of Beginning.
Containing 6.67 acres.
is hereby rezoned from District
CPO-1 (Administrative, Professional and Research/High Buildings) to District O
(Office), all as shown outlined on a map marked Section 80-11A0594, which is
attached hereto and made a part hereof, and which is hereby adopted as a part
of an amendment to the zoning maps constituting a part of said chapter and as
an amendment to Section 80-11 thereof.
Section B. That a
development plan for the area legally described above is hereby approved,
subject to the following conditions:
1. That
the developer shall cause the area to be platted and processed in accordance
with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri,
commonly known as the Subdivision Regulations.
2. That
the developer submits a macro/micro storm drainage study to the City Engineer's
Office for approval for the entire development when the first plat is
submitted, and that the developer construct any improvements as required by the
City Engineer's Office.
3. That
the developer dedicate additional right of way for a secondary arterial with a
bike path as required by the Department of Public Works so as to provide a
minimum of 46 feet of right of way as measured from the centerline of N.W. 72nd Street.
4. That
the developer submit a revised traffic study to address medical office trip
generation and make improvements in accordance with the revised traffic study.
5. That
the developer obtain the grading consents, and all grading, temporary
construction and drainage/sewer easements from the abutting property owner
prior to submitting any public improvements.
6. That
the developer subordinate to the City all private interest in the area of any
right-of-way dedication as required by the Department of Public Works, and that
the developer shall be responsible for all costs associated with subordination
activities.
7. That
the developer secure permits to construct or reconstruct existing sidewalks,
curb, gutter, storm sewers, and streetlights as necessary along all development
street frontages, as required by the Department of Public Works, prior to
recording the next plat.
8. That
any relocated streetlights be integrated into the existing street light system
as required by the City Engineers Office.
9. That
the developer obtain a permit from the Missouri Department of Transportation
(MODOT) as required prior to working in State highway right-of-way.
10. That
the developer submit plans for grading, siltation, and erosion control to the
City Engineer's Office for approval and permitting prior to beginning any
construction activities.
11. That
the developer secure a site disturbance permit from the Department of Public
Works prior to beginning any construction, grading, clearing, or grubbing
activities, if the disturbed area exceeds one acre.
12. That
the developer secure a land disturbance permit from Missouri Department of
Natural Resources if the disturbed area for the entire development exceeds one
acre.
13. That the developer extend
sanitary sewers and provide a storm water conveyance system to ensure
individual service is provided to all proposed lots and determine adequacy as
required by the Department of Public Works.
14. That
the developer submit covenants, conditions and restrictions to the Law
Department for approval for the maintenance of private open space and enter
into a covenant agreement for the maintenance of any stormwater detention area
tracts.
15.
That adequate sight distance be provided to the driveway connection to N.W. 72nd Street as required by the Department of Public Works.
16.
That the developer submit a final plan to the City Plan Commission for
approval, including detailed information on landscaping, signage (including
elevations), lighting (including a photometric study showing zero footcandles
and no illumination beyond the O district property lines), and building
elevations.
A copy of said development plan
is on file in the office of the City Clerk under Document No. 041211, which is
attached hereto and made a part hereof.
Section C. That the
Council finds and declares that before taking any action on the proposed
amendment hereinabove, all public notices and hearings required by the Zoning Ordinance
have been given and had.
