ORDINANCE NO. 920332

 

Amending Ordinance No. 911299, passed October 31, 1991, by repealing and reenacting Section 5 thereof to provide for part of the costs to be assessed in accordance with Kansas City Charter Section 263 as provided in the declaration of necessity.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Ordinance No. 911299, passed October 31, 1991, is hereby amended by repealing Section 5 thereof, authorizing special assessments and explaining the manner of assessment and terms of payment, and enacting in lieu thereof a new section of like subject, to read as follows:

 

Section 5. That special assessments are hereby

authorized to be made and levied upon the lands fronting and abutting on the above improvements. Costs relating to the replacement of sidewalks shall be assessed in accordance with Kansas City Charter Section 286. Costs relating to curbs, driveway entrances, landscaping restoration, utility adjustments and all other work to be assessed shall be assessed in accordance with Section 263 of the Kansas City Charter. Special tax bills evidencing the amount of such assessments shall be issued to Kansas City and shall be credited to the said Revolving Public Improvements Fund and, when collected, the proceeds thereof shall be returned to and become a part of the said fund. The said tax bills shall be made payable in ten annual installments at such times and with such effect as is provided in Article VIII of the Kansas City Charter. The said special assessments shall bear interest at a rate per annum equal to the rate of ten year United States treasury notes as established at the last auction before the assessment is certified to the Director of Finance. If delinquent, said special assessments shall bear interest at a rate per annum two percent higher than the interest rate on assessments which are not delinquent.

 

Section B. That all sections of Ordinance No. 911299 not repealed and reenacted above shall remain effective.
