ORDINANCE NO. 120045
Authorizing execution of an
amendment to a contract with the Economic Development Corporation of Kansas
City, Missouri by increasing the maximum amount of compensation to $8,706,361.00
for the provision of special services to the City under the Neighborhood
Stabilization Program (NSP).
WHEREAS, on July
30, 2008, the U.S. Congress approved the Housing and Economic Recovery Act of
2008 (HERA), to be administered by the U.S Department of Housing and Urban
Development (HUD) and appropriated approximately $3.92 billion of emergency
assistance for redevelopment of abandoned and foreclosed homes, of which the
City received an allocation of $7,323,734.00.00; and
WHEREAS, Title
III of HERA established the Neighborhood Stabilization Program (NSP) which
requires that this funding be made available to cities on a formula basis as
Community Development Block Grant funds are provided; and
WHEREAS, the
City issued Request for Proposals/Qualifications No. EV000673 from entities
interested in being named the Neighborhood Stabilization Program Land Bank and
Special Services Subrecipient; and
WHEREAS, EDC was
selected as Subrecipient to administer activities included in the HUD approved
NSP Amendment to the City Consolidated Action Plan and the City subsequently
entered into a contract (No. 10006) for services in the amount of
$6,861,361.00; and
WHEREAS,
Ordinance No. 100769 authorized an amendment to Contract No. 10006 by
increasing the amount of the contract to $7,046,361.00; and
WHEREAS, the
City needs to provide additional compensation to the Economic Development
Corporation of Kansas City, Missouri (EDC) to cover the administrative and
purchase/rehabilitation costs of carrying out eligible NSP activities from
October 1, 2011 through September 30, 2012; NOW, THEREFORE,
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section 1. That
the Interim Director of Housing and Community Development is hereby authorized
to enter into an amendment to contract No. 10006 to increase the maximum amount
of compensation that the City may pay the Economic Development Corporation of
Kansas City, Missouri to $8,706,361.00. The $1,660,000 in increased
compensation shall be funded through NSP program income. A copy of the
contract, in substantial form, is on file in the office of the Interim Director
of Housing and Community Development and is incorporated herein by reference.

I hereby certify
that there is a balance, otherwise unencumbered, to the credit of the
appropriation to which the foregoing expenditure is to be charged, and a cash
balance, otherwise unencumbered, in the treasury, to the credit of the fund
from which payment is to be made, each sufficient to meet the obligation hereby
