COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 040549
Declaring the area on the
north side of 18th Street between McGee and Oak Street a blighted and
insanitary area in need of redevelopment and rehabilitation pursuant to the
Missouri Planned Industrial Expansion Authority Law, and approving the General
Development Plan for the same to be known as the 18th & McGee Planned Industrial
Expansion Authority Plan.
WHEREAS, Section
100.300, et seq., Revised Statutes of Missouri, as amended, provides that a
legislative body may approve a declaration of blight and approve a general
development plan for the same area simultaneously; and
WHEREAS, it is
desirable and in the public interest that the Planned Industrial Expansion
Authority of Kansas City, Missouri (PIEA), submit a General Development Plan
for an area generally located north of 18th Street between McGee and Oak; and
WHEREAS, said
area is blighted due to the insanitary or unsafe conditions, deterioration of
site improvements, and a combination of such factors as to constitute an
economic or social liability to the public health, safety, morals or welfare;
and
WHEREAS, the
redevelopment of the 18th & McGee PIEA Planning Area as described
herein is in the public interest inasmuch as its redevelopment will preserve
the public health and safety and the economic viability of Kansas City,
Missouri; and
WHEREAS, the Planned
Industrial Expansion Authority has reviewed the proposed redevelopment plan for
the 18th & McGee PIEA Planning Area and has considered whether the
proposed plans uses and building requirements in said area are designed with
the general purpose of accomplishing and conforming with the general plan for
coordinated, adjusted, harmonious development of the City and its environs, in
accordance with present and future needs; and will promote health, safety,
morals, order, convenience, prosperity and the general welfare, as well as
efficiency and economy in the process of development; including among other
things, adequate provision for traffic, vehicular parking, the promotion of
safety from fire, panic and other dangers, and adequate provision for light and
air; the promotion of the healthful and convenient distribution of population,
water, sewage, and other public utilities, schools, parks, recreational and
community facilities and other public improvements; the promotion of sound
design and arrangement; the wise and efficient expenditure of public funds; and
the prevention of the reoccurrence of unsanitary areas, conditions of blight
and deterioration or underdeveloped industrial use and did recommend approval
of such Plan on February 13, 2004; and,
WHEREAS, the City
Plan Commission has reviewed and recommended approval of the finding of blight
and of the General Development Plan for the 18th & McGee Planning Area on
June 1, 2004, as evidenced by its resolution and has found said plan to be in
conformance with the general plan for the development of the community as a
whole, a copy of 040549 which resolution is attached hereto and incorporated
herein by reference as Exhibit "A"; and
WHEREAS, Section
100.400, RSMo, authorizes the Council to approve a General Development Plan and
a designation of blight if the Council finds that the Plan is feasible and in
conformity with the general plan for the redevelopment of the community as a
whole; and
WHEREAS, the
Council has determined that ad valorem tax exemption benefits as authorized in
Section 100.570, RSMo are necessary to attract developers to the area; NOW,
THEREFORE,
BE IT ORDAINED BY
THE COUNCIL OF KANSAS CITY:
Section 1. That
the proposed Planned Industrial Expansion area identified as the 18th &
McGee Planned Industrial Expansion Area, generally located on the north side of
18th Street between McGee and Oak and more specifically described as:
The
South 2.3 feet of Lot 405, and all of Lot 406, except that part taken for McGee
Street, Block 30, McGees Addition, a subdivision in Kansas City, Jackson
County, Missouri, according to the recorded plat thereof.
Lots 407
and 408, except that part taken for McGee Street, Block 30, McGees Addition, a
subdivision in Kansas City, Jackson County, Missouri, according to the recorded
plat thereof.
West 118
feet of Lots 4 through 6, Block 3, B.F. Evans Addition, a subdivision in Kansas
City, Jackson County, Missouri.
West 118
feet of Lots 7 through 11, Block 3, B.F. Evans Addition, a subdivision in
Kansas City, Jackson County, Missouri.
is a blighted area and in
need of redevelopment and rehabilitation and is appropriate for a planned
industrial expansion project, and that the undertaking by the Planned
Industrial Expansion Authority of Kansas City, Missouri, of surveys and plans
for a planned industrial expansion project of the character contemplated by
Section 100.300, et seq., Revised Statutes of Missouri, as amended, (RSMo) in
the proposed planned industrial expansion area is hereby approved.
Section 2. That
the General Development Plan for 18th & McGee PIEA Planning Area generally
located on the north side of 18th Street, between McGee and Oak and legally
described above is hereby approved. A copy of said plan is attached hereto and
incorporated herein by reference as Document No. 040549.
Section 3. That
the Council has duly made the findings necessary for compliance with Section
100.300-100.620 RSMo.
Section 4. That
said General Development Plan is hereby found to be feasible and in conformance
with the general plan for the development of the community as a whole.
Section 5. That
the ad valorem tax exemption benefits as authorized in Section 100.570, RSMo,
are hereby extended to the plan area to the extent and in the manner as
provided for in said General Development Plan.
Section 6. That
the Council finds and declares that before taking any action on the proposed
declarations of blight and General Development Plan, all public notices and
hearings required by law have been given and had.
