COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 970137, AS AMENDED

 

Approving an amendment to a previously approved preliminary plan in District CP-2 (Local Planned Business Center) on approximately a 17.75 acre tract of land generally located at the southeast corner of N.E. Vivion Road and N. Antioch Road. (5642-CP-9)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved preliminary plan in District CP-2 (Local Planned Business Center) on an approximately 17.75 acre tract of land generally located at the southeast corner of N.E. Vivion Road and N. Antioch Road, and more specifically described as follows:

 

That area beginning at the point of intersection of the centerline of Antioch Road and the centerline of 50th Street north; thence easterly along the centerline of 50th Street north to its point of intersection with a straight line which lies generally north and south and intersects the southwest corner of Lot 30, Beulmar Acres, a subdivision in Kansas City, Clay County, Missouri and intersects with the north line of said Lot 30 at a point which lies 15.40 feet east of the northwest corner of said Lot 30; thence northerly along said generally north and south straight line to its point of intersection with a straight line which lies generally northwesterly and southeasterly and intersects the east line of Lot 55 in said Beulmar Acres at a point 50 feet southwest of the northeast corner of said Lot 55 and intersects the west line of said Lot 55 at a point 55 feet southwest of the northwest corner of said Lot 55; thence northwesterly along said line which lies generally northwesterly to southeasterly to its point of intersection with the centerline of Antioch Road; thence southerly along the centerline of Antioch Road to the point of beginning; and that an area beginning at the point of intersection of the centerline of Vivion Road and the northwesterly prolongation of the northeast line of Lot 54, Beulmar Acres, a subdivision in Kansas City, Clay County, Missouri; thence northeasterly along the centerline of Vivion Road to its point of intersection with the centerline of Chouteau Trafficway; thence southeasterly along the centerline of Chouteau Trafficway to its point of intersection with the northerly prolongation of the east line of Lot 43 in said Beulmar Acres; thence southerly along said northerly prolongation of/and the east line of Lot 43 and along the east line of Lots 44, 45, 46, all in said Beulmar Acres and the southerly prolongation thereof to the centerline of 50th Street north; thence westerly and southwesterly along the centerline of 50th Street north to its intersection with a straight line which lies generally north and south and intersects the southwest corner of Lot 30 in said Beulmar Acres and intersects the north line of said Lot 30 at a point which lies 15.40 feet east of the northwest corner of said Lot 30; thence generally northerly along said north-south straight line to its intersection with a straight line which lies generally northwesterly and southeasterly and intersects the east line of Lot 55, Beulmar Acres at a point which lies 50 feet southwest of the northeast corner of said Lot 55 and intersects the west line of said Lot 55 at a point which lies 55 feet southwest of the northwest corner of said Lot 55; thence northwesterly along said northwesterly and southeasterly straight line to its intersection with the east line of said Lot 55; thence northerly along said east line of Lot 55 to the southeast corner of Lot 54 in said Beulmar Acres; thence northeasterly along the southeast line of said Lot 54 to the easternmost corner of said Lot 54; thence northwesterly along the northeast line of said Lot 54 and its northwesterly prolongation to the point of beginning.

 

is hereby approved, subject to the following conditions:

 

1. That the developer construct sidewalks on the south side of N.E. Vivion Road and on the southwest side of N.E. Chouteau Trafficway along the K-Mart frontage prior to

the issuance of a building permit.

 

2. That the developer design and construct the tower to allow co-location of an additional carrier.

 

3. That the developer submit a final plan to the City Plan Commission for approval, including plans for landscaping, prior to the issuance of a building permit.

 

A copy of said amendment is on file in the office of the City Clerk under Document No. 970137, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
