ORDINANCE NO. 130777

 

Amending the 2013 One-Year Action Plan and authorizing submission of the Substantial Amendment to the U.S. Department of Housing and Urban Development; appropriating funds and estimating revenue in the amount of $1,450,000.00 in the Community Development Block Grant Fund; authorizing a contract in the amount of $1,500,000.00 with Morningstar’s Development Company, Inc. for the construction of the Morningstar Neighborhood Family Center at 27th and Prospect Avenue; and designating requisitioning authority.

 

WHEREAS, the $4.1 million Morningstar Neighborhood Family Center is a long envisioned multi-use public facility featuring a multi-purpose room, computer lab and classrooms, and dining facility for youth and families; and

 

WHEREAS, on March 8, 2012, through Committee Substitute for Resolution No. 120159, the Council approved the 2012-2016 Consolidated Plan and 2012 One-Year Action Plan recommending $450,000.00 in CDBG funding as part of a $1.5 million City commitment; and

WHEREAS, on January 24, 2013, through Committee Substitute for Resolution No. 121077, the Council approved the 2013 One-Year Action Plan which recommended for $50,000.00 in CDBG funding for the Center; and

WHEREAS, this ordinance authorizes a substantial amendment to the 2013 One-Year Action Plan by reprogramming a combined $1 million of previously budgeted funds in the 2005, 2009, 2010, 2011 and 2012 Action Plans and submission of the amendment to HUD; and

WHEREAS, the $1,500,000.00 will leverage $2.6 million of additional public and private funding commitments to allow construction of a needed public youth and family oriented facility located on the southwest corner of 27th and Prospect as proposed in the 27th and Brooklyn Action Plan Area and identified in the 2012 and 2013 One-Year Action Plans of the Center to commence in 2013; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the Substantial Amendment to the 2013 One-Year Action Plan, prepared pursuant to the National Affordable Housing Act of 1990, as amended, a copy of which in substantial form is attached hereto, is hereby approved.

Section 2. That the Mayor, on behalf of the City of Kansas City, Missouri, is hereby authorized to execute and submit the aforesaid Substantial Amendment to the United States Department of Housing and Urban Development.

Section 3. That revenue in the amount of $1,450,000.00 is estimated in the following account of the Community Development Block Grant Fund:

 

14-2600-570001-477150 Community Development Grant $1,450,000.00

 

Section 4. That $1,450,000.00 is appropriated from the Community Development Block Grant Fund to the following accounts:

 

14-2600-555314-B-G55CDBG12 Public Facilities $ 450,000.00

14-2600-575324-B-G57CDBG13 Public Facilities 1,000,000.00

TOTAL $1,450,000.00

 

Section 5. That the Director of Neighborhoods and Housing Services is hereby authorized to execute a $1,500,000.00 contract with Morningstar’s Development Corporation, Inc. for development costs for the Morningstar Neighborhood Family Center from funds appropriated to the Community Development Block Grant Fund Account Nos. 14-2600-555314 and 14-2600-575324. A copy of the contract, in substantial form, is on file in the office of the Director of Neighborhoods and Housing Services and incorporated herein by reference.

 

Section 6. That the Director of Neighborhoods and Housing Services is designated requisitioning authority for Account Nos. 14-2600-555314 and 14-2600-575324.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
