ORDINANCE NO. 010223
Accepting a Special
Warranty Deed from FirstarBank, Midwest, a successor in interest to Mercantile
Bank, a Kansas state bank of the County of Jackson, State of Missouri,
conveying to Kansas City property in Kansas City, Jackson County, Missouri, for
office space and training use purposes and directing the City Clerk to file
same.
BE IT ORDAINED BY
THE COUNCIL OF KANSAS CITY:
Section 1. That
the following listed deed conveying property to the City of Kansas City,
Missouri, in fee simple for public purposes and recorded in the office of the
Director of Records for Jackson County, Missouri, at Kansas City, under the
instrument number and in the book and page indicated is hereby accepted.

and said property is legally
described as follows:
TRACT I:
Part of the East 1/2 of the Northwest 1/4 of Section 2, Township 48, Range 33,
in Kansas City, Jackson County, Missouri, described as follows: Beginning at
the southeast corner of 60th Terrace and Elmwood, as said streets are now
established, running south along the east line of Elmwood, 414.62 feet; thence
east at right angles to the last described course 350 feet; thence north
parallel with the east line of Elmwood Avenue, 471.20 feet, more or less, to
the south line of 60th Terrace, thence southwesterly along the south line of
60th Terrace, 354.54 feet to the point of beginning.
TRACT
II: Together with a perpetual easement for ingress and egress, as established
by the instrument recorded as Document No. B-248685 in Book B-5139, page 519,
and as modified by the instrument recorded as Document No. K-198587, in Book
K-442 at page 1345, over the following two strips of land, being more
particularly described as follows: Beginning at a point on the south line of
the aforesaid Tract I and 36.0 feet west of the southeast corner thereof;
thence on a bearing of south and along a line parallel with and 36 feet west of
the southerly prolongation of the east line of said tract, a distance of 360.35
feet; thence on a curve to the left having a radius of 35.0 feet and a central
angle of 31E29', a distance of 18.03 feet; thence South 29E31' East, 102.20 feet; thence on a curve to the right having a radius
of 100.0 feet and a central angle of 29E31', a distance
of 51.52 feet; thence South 0E00', 34.04 feet; thence on a
curve to the left having a radius of 229.18 feet and a central angle of 20E49', a distance of 83.27 feet; thence South 20E49' East, 90.65 feet, more or less, to the northerly right of way line
of 63rd Street, as now established, and
A strip
of land 22.0 feet wide across part of the East 1/2 of the Northwest 1/4 of Section
2, Township 48, Range 33 in Kansas City, Jackson County, Missouri, lying 11.0
feet on east side of the following described centerline: Commencing at a point
414.62 feet south and 314.00 feet east of the southeast corner of Elmwood
Avenue and 60th Terrace, as both are not established, said point being 36.0
feet west of the southeast corner of a tract of land conveyed under Document
No. B-284685, in Book B-5139 at page 519; thence due south parallel with the
east right of way line of said Elmwood Avenue, 360.35 feet; thence
southeasterly on a curve to the left, tangent to the last described course and
having a radius of 35.00 feet, an arc distance of 18.03 feet; thence South 29E31'00" East, 102.20 feet to the true point of beginning of the
strip of land herein described; thence continuing South 29E31'00" East, 162.44 feet; thence southeasterly on a curve to the
right, tangent to the last described course and having a radius of 89.00 feet,
an arc distance of 13.51 feet; thence South 20E49'00"
East, 78.68 feet, plus or minus, to the northerly right of way line of 63rd
Street Trafficway, as now established, to the point of termination of this
easement.
Section 2. That
the City Clerk is hereby directed to file a copy of this ordinance with the
Office of the Director of Records for Jackson County, Missouri, as evidence of
the acceptance of the herein described property by the City for public use
purposes.
