COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 110664

 

Approving and authorizing the City Manager to enter into an agreement to transfer the Town of Kansas Pedestrian Bridge to the Port Authority of Kansas City, Missouri; and authorizing the execution of documents necessary for the transfer.

 

WHEREAS, the City Council, with passage of Ordinance No. 100530 on July 15, 2010, authorized the City Manager to execute the Agreement for the Transfer and Conveyance of Real Estate with the Port Authority, said agreement transferring approximately 67.5 acres of real property along the Missouri Riverfront (“Riverfront Parcels”) from the City to the Port Authority; and

 

WHEREAS, the northern portion and elevator tower terminus of the Town of Kansas Pedestrian Bridge (“TOKPB”) is located on one of the Riverfront Parcels being transferred to the Port Authority with the remainder being located primarily within the City rights-of-way; and

 

WHEREAS, the City and the Port Authority cooperated in the City obtaining funding for construction of the TOKPB and, pursuant to a cooperative agreement, the Port Authority constructed the TOKPB, with construction being completed in 2002; and

 

WHEREAS, the parties have agreed that the City’s ownership interest in the TOKPB should be transferred to the Port Authority in conjunction with the transfer of the Riverfront Parcels; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the City Manager is hereby authorized, on behalf of the City, to execute the Town of Kansas Pedestrian Bridge Transfer Agreement with the Port Authority of Kansas City, Missouri, a copy of the agreement which is hereby approved and on file, in substantial form, with the City Clerk, and to execute such other documents required, either under the Agreement or otherwise, to transfer the Town of Kansas Pedestrian Bridge to the Port Authority.

 

Section 2. That the City Manager is hereby authorized to grant an easement, license, encroachment or other interest in favor of the Port Authority for the continuing location of the Town of Kansas Pedestrian Bridge.
