ORDINANCE NO. 050130
Approving an amendment of the
Martin City/Richards-Gebaur Area Plan by amending the Proposed Land Use Plan
and Map for an area of approximately 16.6 acres generally located east of Madison Avenue, northeast of 141st Terrace on both sides of Wyandotte Street by
changing the recommended land uses from industrial uses to commercial/retail
uses. (212-S-12)
WHEREAS, on June
14, 2001, the City Council by Committee Substitute for Resolution No. 010799
adopted the Martin City/Richards-Gebaur Area Plan as a guide for development
and redevelopment of that area generally bounded by Blue Ridge Boulevard on the
north, the Missouri/Kansas state line on the west, Grandview city limits on the
east, and the Cass County and Belton city limits on the south; and
WHEREAS, said
Plan has been amended by Resolution No. 030167, adopted March 6, 2003; and
WHEREAS, after
further review, the City Development Department, it has been deemed appropriate
to amend the Martin City/Richards-Gebaur Area Plan as it affects that area
generally located at east of Madison Avenue, northeast of 141st
Terrace on both sides of Wyandotte Street by changing the recommended land uses
from industrial uses to commercial/retail uses; and
WHEREAS, legal
notice of the public hearing before the City Plan Commission was published on
November 1, 2004, in conformity with state and local laws; and
WHEREAS, the
City Plan Commission considered such amendment to the Proposed Land Use Plan
and Map on January 5, 2005; and
WHEREAS, after
all interested persons were given an opportunity to present testimony, the City
Plan Commission did on January 5, 2005, recommend approval of the proposed
amendment to the Martin City/Richards-Gebaur Area Plan; NOW, THEREFORE,
BE IT RESOLVED
BY THE COUNCIL OF KANSAS CITY:
Section A. That
the second amendment to the Martin City/Richards-Gebaur Area Plan is hereby
approved as to the proposed Land Use Plan and Map for that area of
approximately 16.6 acres generally located east of Madison Avenue, northeast of
141st Terrace on both sides of Wyandotte Street by changing the
recommended land uses from industrial uses to commercial/retail uses. A copy of
the amendment to the Land Use Plan and Map of the Martin City/Richards-Gebaur
Area Plan is attached hereto as Exhibit A and incorporated herein by reference.
Section B. That
the amendment to the Martin City/Richards-Gebaur Area Plan is consistent and
complies with the FOCUS Kansas City Plan, adopted on October 30, 1997, by
Committee Substitute for Resolution No. 971268, and is adopted as a supplement
to the FOCUS Kansas City Plan.
Section D. That
the Council finds and declares that before taking any action on the proposed
plan, all public notices and hearings required by law have been given and had.
