ORDINANCE NO. 900539

 

Amending Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 65.010A2348, rezoning an area of approximately 59.1 acres on the east side of N.E. Chouteau Trafficway at N.E. 33rd Terrace from Districts MP (Planned Industrial District) and M-1-p (Light Industrial - Limited District) to District M-1-p (Light Industrial - Limited District), and approving a preliminary plan for the same. BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance is hereby amended by enacting a new section to be known as Section 65.010A2348, rezoning an area of approximately 59.1 acres on the east side of N.E. Chouteau Trafficway at N.E. 33rd Terrace from Districts MP (planned industrial district) and M-1-p (light industrial - limited district) to District M-1-p (light industrial- limited district), said section to read as follows:

 

Section 65.010A2348. That an area legally described as:

 

Beginning at a point on the South line of the Northeast Quarter of the Southeast Quarter of Section 7, Township 50 North, Range 32 West at the point of intersection with the easterly right of way line of N.E. Chouteau Trafficway as it now exists, said point also being the northwest corner of Lot 5 in Buckeye Industrial Park, a subdivision, in Kansas City, Clay County, Missouri; thence North 2029'53" East along said right of way, 199.17 feet; thence North 5013'53" East, continuing along said right of way, 98.53 feet; thence North 8816'47" East, a distance of 40.00 feet to the northeast corner of Lot 13 of North Kansas City Heights, a subdivision of land in Kansas City, Clay County, Missouri; thence North 050'04" West along the East line of Lot 14 of said North Kansas City Heights, a distance of 23.03 feet to a point on the southerly line of N.E. 34th Street Terrace; thence South 8545'32" East along the Southerly line of N.E. 34th Street Terrace, a distance of 378.30 feet to a point on the centerline of North Myrtle Avenue; thence North 040'23" West along the centerline of North Myrtle Avenue, a distance of 425.10 feet to a point 660.00 feet south of the north line of the Southeast Quarter of said Section 7, thence North 8806'31" East and parallel with the north line of the Southeast Quarter of said Section 7, a distance of 606.38 feet to a point on the East line of the Southeast Quarter
of said Section 7; thence South 040'23" East along the east line of the Southeast Quarter of said Section 7, a distance of 351.53 feet; thence North 6048'28" East a distance of 692.65 feet; thence North 8919'37" East, a distance of 165.00 feet; thence South 040'23" East, a distance of 620.00 feet to a point on the north line of the Southwest Quarter of the Southwest Quarter of said Section 8; thence North 8809'50" East along the north line of the Southwest Quarter of the Southwest Quarter of said Section 8, a distance of 540.00 feet to the northeast corner of the Southwest Quarter of the Southwest Quarter of said Section 8; thence South 058'01" East along the east line of the Southwest Quarter of the Southwest Quarter of said Section 8, a distance of 370.00 feet; thence South 8901'59" West, a distance of 100.00 feet; thence South 058'01" East and parallel with the east line of the Southwest Quarter of the Southwest Quarter of said Section 8, a distance of 345.00 feet; thence North 7648'16" West, a distance of 959.09 feet to the southeast corner of Lot 10 in said Buckeye Industrial Park; thence North 730'39" East along the east line of Lot 10, a distance of 490.92 feet to the north right of way line of N.E. 34th Street; thence northwesterly along a curve to the left and having a radius of 896.30 feet an arc distance of 106.63 feet; thence North 8919'19" West, tangent to previous stated curve, a distance of 174.05 feet; thence along a curve to the right, tangent to last named course and having a radius of 25.00 feet, an arc distance of 39.70 feet; thence North 8819'21" West, a distance of 60.00 feet; thence South 140'39" West, a distance of 56.47 feet to the south line of the Northeast Quarter of the Southeast Quarter of aforesaid Section 7; thence North 8918'19" West along said south line, 1142.54 feet to the point of beginning.

 

 

is hereby rezoned from Districts MP (planned industrial district) and M-1-p (light industrial - limited district) to District M-1-p (light industrial - limited district), all as shown outlined on a map marked Section 65.010A2348, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 65.010 thereof.

 


Section B. That a preliminary plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer extend water mains in accordance with current City standards and regulations.

 

2. That the developer cause the additional area to be platted and processed in accordance with Chapter 31, Code

of General Ordinances of Kansas City, Missouri, as

amended, commonly known as the Subdivision Regulations.

 

3. That the developer construct interior streets to collector street standards.

 

4. That the developer submit a storm drainage study to the City Engineer including provision for any needed

improvements.

 

5. That the developer secure the vacation of N. Jackson, north of N.E. 34th Terrace to the north property line of

the subject property.

 

6. That the developer dedicate 5 feet of additional right of way for N. Myrtle Avenue.

 

7. That the developer dedicate 60 feet of right of way for all interior streets and 120 feet right of way for the

cul-de-sac.

 

8. That the developer extend sanitary sewers to serve each water shed separately.

 

9. That the developer secure construction permits from the State Highway Department for all work within State right

of way.

 

10. That the developer improve N. Myrtle Avenue north of N.E. 34th Terrace to meet City standards for collector

streets.

 

11. That the developer secure the acceptance of improvements to Chouteau Trafficway by the State Highway Department.

 

12. That the developer submit a final grading plan to City staff for review and approval.


A copy of said preliminary plan is on file in the office of the City Clerk under Document No. 900539, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
