ORDINANCE NO. 061253
Approving the First Amendment to the General Development
Plan for the Crossroads Planning PIEA Area which expands the original area to
include an area of approximately 4.39 acres generally bounded by 20th Street on
the south, 18th Street on the north, Grand Avenue on the east and Walnut Street
on the west; declaring the additional area of approximately 4.39 acres to be a
blighted and insanitary area in need of redevelopment and rehabilitation
pursuant to the Planned Industrial Expansion Authority law; finding the First
Amendment to the General Development Plan for the area to be in compliance
with Sections 100.300-100.620, RSMo; and approving the ad valorem tax benefits
therefore.
WHEREAS, the
Planned Industrial Expansion Authority of Kansas City, Missouri, (the Authority)
found that the Crossroads Planning PIEA Area to be blighted pursuant to Sections
100.300-100.620, RSMo (PIEA Law) and recommended to the City Council that
said area be designated as a blighted, insanitary or underdeveloped industrial
area defined by Section 100.310 (2, 11 and 18), RSMo; and
WHEREAS, said area
was declared to be blighted by the City Council through passage of Ordinance
No. 030118 and a General Development Plan was approved for the area known as
the Crossroads Planning Area General Development Plan; and
WHEREAS, on September 21, 2006, the Authority adopted Resolution No. 1137 accepting the Amended Blight
Study for the area and finding the additional area of approximately 4.39 acres
located bounded by 20th Street on the south, 18th Street on the north, Grand
Avenue on the east and Walnut Street on the west, to be blighted, insanitary or
underdeveloped industrial area defined by Section 100.310 (2, 11 and 18), RSMo,
and approving the First Amendment to the General Development Plan for the Crossroads
Planning PIEA Area; and
WHEREAS, the City
Plan Commission reviewed and recommended approval of the First Amendment to the
General Development Plan for the Crossroads Planning PIEA Area on November 7, 2006, and has found said plan to be in conformance with the general plan for
development of the community as a whole; and
WHEREAS, Section
100.400, RSMo, authorizes the Council to approve a general development plan
after a designation of blight if the Council finds the plan is feasible and in
conformity with the general plan for the redevelopment of the community as a
whole; and
WHEREAS, the Council
has determined that ad valorem tax exemption benefits as authorized by Section
100.570, RSMo, are necessary to attract developers to the additional area of
the Crossroads Planning PIEA Area; NOW, THEREFORE,
BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:
Section 1.
That the Council declares the additional area of approximately 4.39 acres
generally bounded by 20th Street on the south, 18th Street on the north, Grand Avenue on the east and Walnut Street on the west, and more specifically described as
follows:

South 34.5 feet of Lot 445, north 48.5 feet of Lot 446, Block 33, McGees
Addition, a subdivision in Kansas City, Jackson County, Missouri.
1800-20 Grand
Boulevard: Lots 436 thru 441, Block 33, McGees Addition, a subdivision in Kansas City, Jackson County, Missouri.
1811 Walnut: South
1 foot of Lot 446, all of Lots 447-448 and 449, Block 33, McGees Addition, a

to be a blighted, insanitary or
undeveloped industrial area in need of industrial development as defined in
Section 100.310, RSMo, which constitutes an economic or social liability or a
serious and growing menace, which is injurious to the public health, safety,
morals, economy and welfare of the residents of Kansas City, and finds that the
elimination or prevention of the detrimental conditions in such area by the
commercial development of such area is necessary and in the interest of the
public health, safety, morals, economy and welfare of such residents.
Section 2. That
the First Amendment to the General Development Plan for the Crossroads Planning
PIEA Area, dated September 13, 2006, and described herein, by including the
said additional area of approximately 2.0 acres, is hereby approved. A copy of
said First Amendment to the General Development Plan for the Crossroads
Planning PIEA Area is attached hereto and incorporated herein by reference with
this ordinance.
Section 3. That
this Council has duly made the findings necessary for compliance with Sections
100.300 through 100.620, RSMo.
Section 4. That
said First Amendment to the General Development Plan for the Crossroads
Planning PIEA Area is hereby found to be feasible and in conformance with the
general development plan for the community as a whole.
Section 5. That
the ad valorem tax exemption benefits as authorized in Section 100.570, RSMo,
are hereby extended to the plan area, as amended by the First Amendment to the General
Development Plan, to the extent and in the manner provided for in said First
Amendment to the General Development Plan for the Crossroads Planning PIEA Area,
subject to the execution of a development agreement with the Authority.
