ORDINANCE NO. 120882
Determining that a public benefit
will be gained by the waiver of a demolition lien on the property located at
2826 Prospect Avenue; and authorizing the City Manager to waive the lien.
WHEREAS, there
exists a demolition lien against the property located at 2826 Prospect Avenue
(“Property”), which is currently owned by the Land Clearance for Redevelopment
Authority (“LCRA”) and which was owned by the Housing and Economic Development
Financial Corporation (“HEDFC”) at the time of demolition, in the amount of
$37,145.66; and
WHEREAS, the
structure located on the Property was designated a dangerous building and
removed by the City of Kansas City, Missouri and the demolition lien stands as
an impediment to the redevelopment of the site and surrounding properties; and
WHEREAS, the
Metropolitan A.M.E. Zion Church (“Church”) would like to acquire the Property
which is adjacent to their current location, in order to further the Church’s
long term plan; and
WHEREAS, the
HEDFC offered the Property to the Church who was unable to accept the Property
with the outstanding lien in place; and
WHEREAS, the
LCRA agreed to accept the property from HEDFC and has, by Resolution No. 7-01-12,
agreed to transfer the property to the Church subject to the successful waiver
of the demolition lien; and
WHEREAS, the
Church agrees to maintain the Property as a side yard to their current property
until such time as funding is available to incorporate the site into the
proposed Church complex; and
WHEREAS, the
Lien Waiver Committee recommends waiver of this lien and all accrued interest;
NOW, THEREFORE,
BE IT ORDAINED BY THE
COUNCIL OF KANSAS CITY:
Section 1. That in
accordance with Section 56-547(3) of the Code of Ordinances, the Council finds
and determines that a public benefit will be gained by the waiver of the
demolition lien on the Property in that the proposed improvements will clear
blight, remediate environmental hazards and promote redevelopment.
Section 2. That
in accordance with Section 56-547(1) of the Code of Ordinances, the City
Manager is hereby authorized to waive the aforementioned demolition lien, thus
facilitating the transfer of the Property from LCRA to the Church.
