ORDINANCE NO. 051453

 

Approving a $264,116.60 Amendment 2 to a Cooperative Agreement with the Planned Industrial Expansion Authority for construction, coordination, and contract administration of certain storm sewer improvements for the Central Industrial District of Kansas City, Missouri; authorizing the Director of Water Services to expend $264,116.60 for this project; and authorizing the Director of Finance to return unexpended appropriations to the appropriate account therefore.

 

WHEREAS, the City Council passed Ordinance No. 030196 on March 6, 2003, authorizing a Cooperative Agreement between Kansas City, Missouri and the Planned Industrial Expansion Authority for construction and construction contract administration of storm sewer improvements along Madison/Belleview from Woodswether Road to 8th Street, and along 8th Street from Madison/Belleview to Mulberry Street; and

 

WHEREAS, the City Council passed Ordinance No. 041405 on December 14, 2004, authorizing Amendment 1 to a Cooperative Agreement between Kansas City, Missouri and the Planned Industrial Expansion Authority to provide additional funds for construction work in relation to shoring, replacement of unstable roadway subgrades which impacted the integrity and useful life of the storm sewer improvements, and other minor modifications to the project; and

 

WHEREAS, this ordinance is needed for authorizing Amendment 2 of the Cooperative Agreement with PIEA, which involves additional funds for construction work in relation to shoring as well as an extension of the contract term; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Director of Water Services is hereby authorized to enter into and execute, on behalf of Kansas City, a $264,116.60 Amendment 2 to a Cooperative Agreement with the Planned Industrial Expansion Authority of Kansas City, Missouri, for the construction, coordination, and contract administration of certain storm sewer improvements for the Central Industrial District of Kansas City, Missouri from funds previously appropriated in Account No. 06-8200-807760-B, Stormwater Construction. A copy of the amendment is on file in the office of the Director of Water Services Department.

 

Section 2. That upon completion of the final costs of this amendment, the Director of Finance is authorized to return the unexpended portion of the appropriation to the Unappropriated Fund Balance from which it was derived.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
