Approving a Community Unit Project in District R-1a on a 81.7 acre tract of and generally located on both sides of Crysler Avenue between E. 53rd Street and E. 58th Street, and both sides of E 58th Street from Crysler Avenue to Norfleet Road; and changing the street name of Chrysler Avenue to Crysler Avenue within the plat of Rolling Meadows. BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a Community Unit Project in District R-1a (One-Family Dwellings, Medium Density) on an approximately 81.7 acre tract of land generally located on both sides of Crysler Avenue between E. 53rd Street and E. 58th Street, and both sides of E 58th Street from Crysler Avenue to Norfleet Road, and more specifically described as follows:

 

Part of Section 34, Township 49 North of the Baseline, Range 32 West of the Fifth Principal Meridian, Kansas City, Jackson County, Missouri, described as follows: All of Lots 1 through 79 and Tract A, "ROLLING MEADOWS PLAT", a Subdivision of Record; All of Lots 80 through 123 and Tract B, "ROLLING MEADOWS 2ND PLAT", a Subdivision of Record; All of Lots 124 through 136, "ROLLING MEADOWS 3RD PLAT", a Subdivision of Record, together with the following described tract:

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed, including a replat of the proposed swimming pool tract, in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2. That the developer submit a macro overall storm drainage study for the entire development to Development Services for approval at the time of submittal of the first plat, with a micro detailed storm drainage study to be submitted for each phase at the time of final platting, and that the developer construct any improvements as required by Development Services.

 

3. That the developer obtain the grading consents, and all grading, temporary construction and drainage/sewer easements from the abutting property owner prior to submitting any public improvements.

 

4. That the developer secure permits to construct new or reconstruct existing sidewalks, curbs and gutters along the project frontage as required by Development Services with the issuance of the building permit.

 

5. That the developer submit plans for grading and siltation and erosion control to Development Services for approval prior to beginning any construction activities.

 

6. That the developer secure a land disturbance permit from Development Services prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

7. That the developer extend sanitary sewers and/or storm sewers to ensure individual service is provided to all proposed lots and determine adequacy as required by Development Services.

 

8. That the developer show the lowest opening or elevation or Minimum Low Opening (MLO) of any structure on each lot that abuts a 100 year floodplain area on the final plat.

 

9. That the developer submit covenants, conditions and restrictions to the Law Department for approval and enter into a covenant agreement for the maintenance of any stormwater detention area tracts.

 

10. That the developer provide exclusive easements and extend water mains as required by the Water Services Department.

 

11. That the developer secure approval of the Street Naming Committee for all street names prior to submittal of the first final plat, and that the developer submit a copy of the approved street name plan as part of each final plat submittal to the Department of City Development.

 

12. That the developer contribute $15,325.40 in lieu of parkland dedication for 84 single-family units (84 units X 3.7 X .006 (less credit for the swimming pool tract) X $9,961.61 (year 2005) = $15,325.40) in satisfaction of Section 66-128 of the Subdivision Regulations.

 

13. That the developer secure the approval of the Board of Zoning Adjustment for any proposed subdivision identification signs prior to requesting a sign permit.

 

14. That the developer submit a street tree planting plan as part of the final plat with a copy to be submitted to the Department of City Development, secure the approval of the City Forester for street trees planted on right of way in front of residential lots, and plant the street trees in conformance with the plan approved by the City Forester. The plan shall include size, type, species and placement of trees.

 

15. That the developer submit a final plan for the swimming pool tract to the City Plan Commission for approval, including detailed information on landscaping, signage (including elevations), lighting (including a photometric study showing zero foot-candles at the property line and no direct illumination beyond the tract boundary)and building elevations.

 

A copy of said Community Unit Project plan is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the name of Chrysler Avenue within the plat of Rolling Meadows, shall be changed to Crysler Avenue, all within Section 34, Township 49 North, Range 32 West, Kansas City, Jackson County, Missouri. The change is indicated on the map attached hereto and made a part hereof. Existing traffic ordinances on this street will remain in effect and will not be affected by the street name change.

 

Section C. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
