COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 951438

 

Approving a General Development Plan pursuant to the Planned Industrial Expansion Law for the Plaza East area generally bounded by 47th Street on the north, Volker Boulevard on the south, Troost Avenue on the west, and Paseo Boulevard on the east except for an area generally located at the northeast corner of Troost Avenue and Volker Boulevard; declaring the area included in such plan to be a blighted area, insanitary or undeveloped area and its redevelopment necessary for the preservation of the public peace, prosperity, health, safety, morals and welfare; and approving the ad valorem tax benefits pursuant to Section 100.570, RSMo 1994.

 

WHEREAS, Section 100.400, Revised Statutes of Missouri, authorizes the legislative body to approve a plan and a designation of blight if the legislative body finds that the plan is feasible and in conformity with the general plan for the development of the community as a whole; and

 

WHEREAS, the Planned Industrial Expansion Authority did prepare or cause to be prepared a General Development Plan for the Plaza East area; and

 

WHEREAS, the City Plan Commission has reviewed and recommended approval of the finding of blight and of the General Development Plan for the Plaza East area on October 3, 1995, as evidenced by its resolution recommending approval of the adoption of said plan as being within a blighted area and has found said plan to be in conformance with the general plan for the development of the community as a whole, a copy of which resolution is attached hereto and incorporated herein by reference as Exhibit "A"; and

 

WHEREAS, the Council has determined that ad valorem tax exemption benefits as authorized in Section 100.570, RSMo 1994, are necessary to attract developers in the area; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Council declares the area generally bounded by 47th Street on the north, Volker Boulevard on the south, Troost Avenue on the west, and Paseo Boulevard on the east except for an area generally located the northeast corner of Troost Avenue and Volker Boulevard, and more specifically described as follows:

 

In Kansas City, Missouri, part of Section 28, Township 49, Range 33: Beginning at the intersection of the north line of 47th Street with the west line of Troost Avenue, then east along the north line of 47th Street to the east line of The Paseo, then south along said east line to the south line of Volker Boulevard, then west along said south line to the west line of Troost Avenue, then north along said west line to the point of beginning except for the following: The south 49 feet of Lot 6, Block 1, Davis Place; all of Lots 7 through 9, inclusive, Block 1, Davis Place; all of Lots 13 through 18, inclusive, Block 1, Davis Place; the south 30 feet of Lot 19, Block 1, Davis Place; the west 115.33 feet of Lots 21 thru 24, inclusive, Block 2, Davis Place; all of Lots E and F, Block 1, Davis Place, a subdivision lying in Kansas City, Jackson County, Missouri; and all of the Northwest 1/4, Southwest 1/4, Section 28, Township 49, Range 33, beginning at the intersection of the south line of 48th Street with the east line of Troost Avenue, thence east along said south line of 48th Street, 275 feet, thence south to the north line of Brush Creek Parkway, thence southwesterly along said north line of Brush Creek Parkway to a point 60 feet east of Troost, thence west 60 feet to the east line of Troost, thence north 533.75 feet to the point of beginning.

 

to be a blighted, insanitary or undeveloped area as defined in Section 100.310, RSMo 1994, which constitutes an economic or social liability or a serious and growing menace, injurious to the public health, safety, morals, economy and welfare of the residents of Kansas City, and the elimination or prevention of the detrimental conditions in such area by the commercial development of such area is necessary and in the interest of the public health, safety, morals, economy and welfare of such residents.

 

Section 2. That the General Development Plan for the Plaza East area being that area generally bounded by 47th Street on the north, Volker Boulevard on the south, Troost Avenue on the west, and Paseo Boulevard on the east except for an area generally located the northeast corner of Troost Avenue and Volker Boulevard and more specifically described as follows:

is hereby approved. A copy of said plan being attached hereto and incorporated herein by reference as Document No. 951438, on file in the office of the City Clerk, is hereby approved.

 

Section 3. That the Council has duly made the findings necessary for compliance with Section 100.400, Revised Statutes of Missouri, as amended.

 

Section 4. That said General Development Plan is hereby found to be feasible and in conformance with the general plan for the development of the community as a whole.

 

Section 5. That the ad valorem tax exemption benefits as authorized in Section 100.570, RSMo 1994, are hereby extended to the areas within the Plan to the extent and in the manner as provided for in said General Development Plan.
