ORDINANCE NO. 110148

Authorizing the Director of Parks and Recreation to enter into a (supplemental) cooperative funding agreement with the Missouri Department of Transportation for construction of a segment of the Brush Creek Trail enhancement, Project STP-3301(408).

WHEREAS, on August 7, 2009, the Commission and the City previously entered into a Transportation Enhancement Funds Agreement as to public improvements designated as STP-3301 (408), for the construction of Brush Creek Trail between Agnes Avenue to Benton Boulevard and lighting from Benton Boulevard to Garfield Avenue, (hereinafter, "Original Agreement"); and

WHEREAS, the Commission and the City now desire to revise the Original Agreement.; and

WHEREAS, the supplemental agreement revises the authorization to advertize date; and

WHEREAS, the trail connector provides shared use bicycle and pedestrian facilities and will provide a connection to segments of Brush Creek Trail already constructed in Kansas City; NOW, THEREFORE,

BE IT ORDAINED BY THE CITY OF KANSAS CITY:

Section 1. That the Director of Parks and Recreation is authorized to execute a Supplemental Agreement with the Missouri Highways and Transportation Commission for the purpose of constructing a segment of the Brush Creek Trail from Agnes Avenue to Benton Boulevard and lighting from Benton Boulevard to Garfield Avenue. The agreement, in substantial form, is on file in the Office of the Director of Parks and Recreation.
