ORDINANCE NO. 971023

 

Condemning and taking private property for permanent right-of-way, abutter's rights of direct access, drainage controls and temporary construction easements to open and establish relocated Missouri State Route 150 from the Missouri-Kansas State Line to a point 2,187.35 feet, along said relocated centerline, East of the centerline of Missouri Route D (Holmes Road), relocated 135th Street from said State Line to a point 2,130 feet, more or less, East of said State Line, relocated 147th Street (Wheeler Road) from Holmes Road to a point 716.63 feet West of Holmes Road, and S.E. Outer Road (present Route 150 and Outer Belt Road) from Holmes Road to a point 736.70 feet East of Holmes Road, and including establishing intersections at relocated 135th Street, Wyandotte Street and Missouri Route D (Holmes Road) said intersection at Route D includes two ramps for entrance and two ramps for exiting said relocated Route 150, and widening of said Route D; establishing and re-establishing street grades and authorizing the grading thereof; and providing for payment of just compensation therefore, in Kansas City, Jackson County, Missouri.

 

WHEREAS, The Council finds that the City has entered into a Cooperative Agreement for Public Improvement and relocation of Missouri Route 150 from the Missouri-Kansas State Line to Holmes Road with the Missouri Highway and Transportation Commission on November 16, 1992, as authorized by Ordinance No. 921209, passed November 5, 1992, wherein the City agrees to share the cost and to be responsible for condemnation proceedings against certain lands and easements, all herein described, which must be acquired in connection with the making of the improvements to the relocated Missouri State Route 150 as provided for and authorized herein; and

 

WHEREAS, The Council further finds that for the public good it is deemed necessary that Missouri State Route 150 shall be relocated and established from the Missouri-Kansas State line to a point 2,187.35 feet East of the centerline of Missouri Route D (Holmes Road), 135th Street (present Route 150) shall be relocated and established from said State Line to a point 2,130 feet, more or less, East of said State Line, 147th Street (Wheeler Road) shall be relocated and established from Holmes Road (Route D) to a point 716.63 feet West of Holmes Road, and the S.E. Outer Road shall be established from Holmes Road (Route D) to a point 736.70 feet East of Holmes Road, including establishing intersections with relocated 135th Street, Wyandotte Street, and Missouri Route D (Holmes Road) said intersection with Holmes Road (Route D) shall include widening of said Holmes Road and providing two ramps for entrance and two ramps for exiting said relocated Route 150 and a relocated entrance drive to property presently known as 800 E. 147th Street, and the grading thereof authorized, NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. Establishing and Widening. That Missouri State Highway 150 shall be relocated and established from the Missouri-Kansas State line to a point 2,187.35 feet, along said relocated centerline, East of the centerline of Missouri Route D (Holmes Road); 135th Street (present Route 150) shall be relocated and established from said State Line to a point 2,130 feet, more or less, East of said State Line, 147th Street (Wheeler Road) shall be relocated and established from Holmes Road (Route D) to a point 716.63 feet West of Holmes Road, and the S.E. Outer Road shall be established from Holmes Road (Route D) to a point 736.70 feet East of Holmes Road, also establishing intersections at relocated 135th Street, Wyandotte Street and Missouri Route D (Holmes Road), said intersection with Holmes Road (Route D) shall include widening of said Holmes Road and providing two ramps for entrance and two ramps for exiting said relocated Route 150 and a relocated entrance drive to property presently known as 800 E. 147th Street, the rights-of-way thereof having various widths, along the centerlines as herein described, all as more fully described in the plans, which are on file in the Office of the Director of Public Works and identified as Public Works File No. 1997-35 and are incorporated herein by reference is hereby provided for and authorized.

 

Said relocated Missouri State Route 150 courses through portions of fractional Section 19, Town 47 North, Range 33 West, fractional Section 30, Town 47 North, Range 33 West, Section 29, Town 47 North, Range 33 West, and Section 28, Town 47 North, Range 33 West, all in Kansas City, Jackson County, Missouri, the centerline of which is described as follows:

 

The Route 150 median centerline is located and described as follows:

 

Commencing at the West corner of fractional Section 19, T47N, R33W; thence North 01051'32" West a distance of 68.23 feet to a point on said centerline at Station 544+63.31; thence North 87032'26" East a distance of 13.54 feet to Station 544+76.85 which equals Station 0+00 of the relocated Missouri State Highway 150 centerline as hereinafter referred; thence the Route 150 centerline continues North 87032'26" East a distance of 20.27 feet to Point of Curve Station 544+97.12 which equals Station 0+20.27 of the relocated Missouri State Highway 150 as hereinafter referred being the beginning of a 40 20' curve to the right with an interior angle of 89059'01" having a radius factor of 1322.21 feet; thence Southeasterly along said curve 1,321.83 feet to Point of Intersection Station 558+18.95, which equals Station 13+42.1 of the relocated Missouri State Highway 150 as hereinafter referred.

 

The Missouri Route 150 relocated centerline is located and described as follows:

 

Commencing at the Southeast corner of the fractional Section 19, T47N, R33W; thence North 79011'19.3" West a distance of 721.11 feet to a point on said centerline at Point of Curve Station 34+93.08, which is the beginning of a 20 curve to the left with an interior angle of 18000'; thence Southerly along said curve a distance of 900 feet to Point of Tangent Station 43+93.08; thence the centerline extends South 15000'00" East a distance of 606.92 feet to Station 50+00. Also from said Station 34+93.08 the centerline extends North 03000'00" East a distance of 1,246.27 feet to Spiral to Tangent Station 22+46.81; thence to the left on a spiral curve a distance of 150 feet to Curve to Spiral Station 20+96.81 (said spiral curve having an X distance of 149.95 feet along the main tangent and a Y distance of 2.84 feet offset from the main tangent); thence Northwesterly along said curve a distance of 756.81 feet to Station 13+40 which equals Relocated 135th Street centerline Station 0+00 as hereinafter referenced; thence continuing along said curve a distance of 1,319.73 feet to Point of Curve Station 0+20.27 equaling said back Station 544+97.12 on the Kansas Route 150 median centerline.

 

The centerline of relocated Missouri State Highway 150 continues in a Southerly and Easterly direction as follows:

 

Continuing from said Station 50+00, South 15000'00" East a distance of 2,004.9 feet to tangent to Spiral Station 70+04.90.

 

The centerline between said Station 70+04.90 and point of curve Station 100+42.26 is described as follows: Commencing at the South corner of Section 29, T47N, R33W; thence North 10025'57.1" East a distance of 823.45 feet to a point on said centerline at Point of Curve Station 100+42.26, which is the beginning of a 01030' curve to the right with an interior angle of 09000'; thence Southeasterly along said curve a distance of 600 feet to Point of Tangent Station 106+42.26. And also, from said Station 100+42.26 the centerline extends North 86010'39" West a distance of 803.72 feet to Spiral to Tangent Station 92+38.54; thence to the right on a spiral curve a distance of 200 feet to Curve to Spiral Station 90+38.54 (said spiral curve having an X distance of 199.93 feet along the main tangent and a Y distance of 4.07 feet offset from the main tangent); thence Northwesterly along a 03030' curve to the right with an interior angle of 64010'39" a distance of 1,833.64 feet to Spiral to Curve Station 72+04.90; thence to the left on a spiral curve a distance of 200 feet to Tangent to Spiral Station 70+04.90 (said spiral curve also having an X distance of 199.93 feet and a Y distance of 4.07 feet).

 

The centerline between said Station 100+42.26 and Station 108+00 is described as follows: Commencing at the South corner of Section 29, T47N, R33W; thence North 10025'57.1" East a distance of 823.45 feet to a point on said centerline at Point of Curve Station 100+42.26, which is the beginning of a 01030' curve to the right with an interior angle of 09000', and also said station is tangent to a line having a bearing of North 86010'39" West; thence Southeasterly along said curve a distance of 600 feet to Point of Tangent Station 106+42.26; thence the centerline extends South 77010'39" East a distance of 157.74 feet to Station 108+00.

 

The centerline between said Station 108+00 and Station 120+41.65 is described as follows: Commencing at the Northeast corner of Section 29, T47N, R33W; thence South 10026'03.9" West a distance of 4,731.98 feet to a point on said centerline at Station 120+41.64; thence said centerline extends North 77010'39" West a distance of 1,241.64 feet to Station 108+00.

 

The centerline between said Station 120+41.65 and Station 145+00 (being the end of this phase of relocation of said Route 150) is described as follows: The Route 150 relocated centerline continues as follows: Commencing at the Northeast corner of Section 29, T47N, R33W; thence South 10026'03.9" West a distance of 4,731.98 feet to a point on the Route 150 relocated centerline at Station 120+41.64 which equals Route D centerline Station 234+21.05 as hereinafter referenced; thence the Route 150 relocated centerline extends South 77010'39" East a distance of 1,025.33 feet to Point of Curve Station 130+66.97, which is the beginning of a 00029'56.3" curve to the left with an interior angle of 04018'18.2"; thence Southeasterly along said curve a distance of 862.79 feet to Point of Tangent Station 139+29.76; thence the centerline extends South 81028'57.2" East a distance of 570.24 feet to Station 145+00.

 

Said relocated 135th Street (currently M150) all in fractional Section 19, Town 47 North, Range 33 West in the City of Kansas City, Jackson County, Missouri, the centerline of which is described as follows: Commencing at Station 0+00 as above referenced; thence the centerline extends North 56057'16.9" East a distance of 501.29 feet to Point of Curve Station 5+01.29, which is the beginning of a 07030' curve to the right with an interior angle of 38015'51"; thence Easterly along said curve a distance of 510.19 feet to Point of Tangent Station 10+11.48, which equals Station 51+77.24 on the centerline of the current Missouri Route 150 (135th Street).

 

Said relocated 147th Street (Wheeler Road) partly in Section 29 and 32, Town 47 North, Range 33 West, Kansas City, Jackson County, Missouri, the centerline of which is described as follows: The Route D centerline is located and described as follows: Commencing at the Northeast corner of Section 29, T47N, R33W; then South 10026'03.9" West a distance of 4,731.98 feet to a point on said centerline at Station 234+21.05; thence the centerline extends South 03049'21" West a distance of 780.02 feet to Station 242+01.07 which equals the 147th Street relocation centerline Station 10+00 as hereinafter referenced; thence continuing South 03049'21" West along the Route D centerline a distance of 220 feet to Station 244+21.07.

 

The 147th Street relocation centerline is located and described as follows: Commencing at Station 10+00 as above referenced; thence the centerline extends North 68010'39" West a distance of 150 feet to Point of Tangent Station 8+50, which is the beginning of a 200 curve to the right with an interior angle of 21044'08"; thence Northwesterly along said curve a distance of 108.68 feet to Point of Curve Station 7+41.32; thence the centerline extends North 46026'31.1" West a distance of 100.45 feet to Point of Tangent Station 6+40.87, which is the beginning of a 200 curve to the left with an interior angle of 39059'08"; thence Northwesterly along said curve a distance of 199.93 feet to Point of Curve Station 4+40.94; thence the centerline extends North 86025'39" West a distance of 157.57 feet to Station 2+83.37.

 

Said S.E. Outer Road, to be established partly in Section 28, 29, 32 and 33, Town 47 North, Range 33 West, Kansas City, Jackson County, Missouri, the centerline of which is described as follows: The Route D centerline is located and described as follows: Commencing at the Northeast corner of Section 29, T47N, R33W; thence South 10026'03.9" West a distance of 4,731.98 feet to a point on said centerline at Station 234+21.05; thence the centerline extends South 03049'21" West a distance of 780.02 feet to Station 242+01.07 which equals Station 0+00 on the S.E. Outer Road centerline as hereinafter referenced; thence the Route D centerline continues South 03049'21" West a distance of 220 feet to Station 244+21.07.

 

The S.E. Outer Road centerline is located and described as follows: Commencing at Station 0+00 as above referenced; thence the centerline extends North 75049'21" East a distance of 168.14 feet to Point of Curve Station 1+68.14, which is the beginning of a 12030' curve to the left with an interior angle of 21058'20"; thence Northeasterly along said curve a distance of 175.78 feet to Point of Reverse Curve Station 3+43.92.

 

Section 2. Width of Roadways. The width of the roadways in Relocated Missouri Route 150, Relocated 135th Street, Relocated 147th Street (Wheeler Road), S.E. Outer Road, ramp 1 and ramp 2 as shown on the plans described hereafter in Section 4 of this ordinance, within the limits described herein be and the same are hereby established as follows:

 

Relocated Missouri Route 150 - Width of Roadway

 

Highway shall be divided with median width being variable between 14 feet and 48 feet.

 

East Bound Lane

 

24 feet from Station 1+29.53 to Station 118+80.00 Deceleration Lane begins on right side at Station 92+92.26 and varies in width from 0 feet to 12 feet at Station 95+42.26. 12 feet from Station 95+42.26 to Station 105+03.54 (Exit ramp 2 begins at Station 105+03.54).

 

(Station 118+80.00 is the end of paving for this phase).

 

West Bound Lane

 

60 feet from Station 1+29.53 to Station 2+73.15 varies from 60 feet to 24 feet from Station 2+73.15 to Station 9+00.00 24 feet from Station 9+00.00 to Station 118+80.00 Acceleration Lane begins on left side at Station 97+42.26 and varies in width from 0 feet to 12 feet at Station 100+42.26. 12 feet from Station 100+42.26 to Station 108+14.34 (Entrance ramp 1 begins at Station 108+14.34)

 

(Station 118+80.00 is the end of paving for this phase).

 

Relocated 135th Street - Width of Roadway

 

24 feet from Station 1+40.00 (Relocated 135th Street) to Station 10+86.48 (Equals Station 52+52.24 of existing Route 150).

 

Relocated 147th Street (Wheeler Road) - Width of Roadway

 

20 feet from a point 725 feet West of the centerline of Holmes Road (Route D) to the West line of said Holmes Road.

 

S.E. Outer Road - Width of Roadway

 

20 feet from the East line of Holmes Road (Route D) to a point 736.70 feet East of the centerline of said Holmes Road.

 

Ramp 1 - Width of Roadway

 

varies 24 feet to 18 feet from Station 11+00.0 to Station 5+00.0

 

18 feet from Station 5+00.00 to Station 0+00.0 (= Station 108+14.34).

 

Ramp 2 - Width of Roadway

Section 3. Establishing the Grades. That the grades on Missouri State Route 150 from the Missouri-Kansas State Line to a point 2,458.36 feet East of the centerline of State Route D (Holmes Road), relocated 135th Street from relocated Route 150 to a point 1,086.48 feet Northeasterly of the centerline of said relocated Route 150, 147th Street (Wheeler Road) from a point on the centerline of Holmes Road (Route D) to a point 725 feet West of said centerline, S.E. Outer Road (present Route 150 and Outer Belt Road) from the centerline of Holmes Road (Route D) to a point 736.70 feet East of said centerline, ramp 1 from Holmes Road (Route D) to a point 1,213.65 feet West of the centerline of said Holmes Road, Ramp 2 from Holmes Road (Route D) to a point 1,618.90 feet West of the centerline of said Holmes Road, Ramp 3 from Holmes Road (Route D) to a point 1,174.49 feet East of the centerline of said Holmes Road, and Ramp 4 from Holmes Road (Route D) to a point 540.00 feet East of the centerline of said Holmes Road, be and the same are hereby determined, and established, and the grades on Wyandotte Street be re-established from a point 660.72 feet South of the centerline median of relocated Missouri Route 150 to a point 778.72 feet North of said centerline median as set forth in Resolution No. 970844, adopted by the Council of Kansas City, Missouri on June 19, 1997, all as shown on the plans on file in the Office of the Director of Public Works.

 

The grades shall be along a line on the centerline of said street, located and defined by the below listed adjacent grade points, which shall be connected by straight grades (tangents) or vertical curves between such grade point, the elevations of which are given below, above the City directrix, as follows to wit:

Section 4. Plans and Specifications. Said improvements shall be of the nature described and specified in, and shall be done in accordance with the plans and specifications certified by the City Engineer under the supervision of the Director of Public Works, prepared and certified by the designee of the Chief Engineer of the State of Missouri, and approved by the Missouri Highway and Transportation Commission by Resolution dated November 5, 1993, and identified as Public Works File No. 1997-35, the same being on file in the Office of the Director of Public Works and being incorporated herein by reference.

 

Section 5. Grading. That the grading of relocated Missouri Route 150, Relocated 135th Street, Wyandotte Street, Relocated 147th Street (Wheeler Road), S.E. Outer Road , Ramp 1, Ramp 2, Ramp 3 and Ramp 4 within the limits described herein, is hereby authorized to be done to the established grades all in accordance with the plans and specifications.

 

Section 6. Embankment. That the grading of the streets or parts thereof, hereby widened or established, to the established or re-established grades of the same, may cause an embankment or fill to be made, leaving abutting property below the proposed grade of the street; and there is hereby condemned in said abutting property an easement or a right to support said embankment or fill so far as may be necessary to bring the street to the required grade by allowing the material of which said embankment is made to fall upon the abutting land at a natural slope so that the surface of the street may be graded. The area of land in which said easement is condemned is hereinafter described and is shown on the plan prepared and on file in the Office of the Director of Public Works, showing a profile of the portion of the streets to be graded and indicating thereon approximately the amount of the encroachment of the embankment upon the abutting property, which said plan is made a part of this ordinance, and just compensation for damages, if any, therefore shall be paid according to law.

 

Section 7. Excavation. That in grading said streets or parts thereof hereby widened or established to the established or reestablished grade of the same, it may be necessary to make certain excavations which will leave the sides of the cuts in such a condition and position that the earth, dirt, rock and other material composing the same will slip, slide, roll or fall into the street obstructing travel and be dangerous to persons using the street, it is , therefore, ordained that in such event and under such circumstances, the sides of such cut shall be sloped back from the shoulder line beginning at the grade of the street, a sufficient distance and on such slope as will leave the street, when the work of such grading is completed, free from such slides and in a reasonably safe condition for travel. The extent of such excavations and slopes of the sides thereof and the distance back on private property to which such slopes may extend, are shown on the plat prepared and on file in the Office of the Director of Public Works, which plat is made a part of this ordinance and there is hereby condemned in the private property abutting on said street where said excavations occur an easement or right to go upon such abutting property and remove such earth, dirt, rock or other material, and just compensation or damage, if any, therefor shall be paid according to law.

 

Section 8. Easements. That permanent right-of-way, abutter's rights of direct access, permanent drainage easements and temporary construction easements are hereby condemned and taken for public use for the location, construction, reconstruction, maintenance, operation and repair of street, drainage and improvements in and upon the lands hereinafter described.

 

The permanent right-of-way shall be used as the permanent location of the public roadways, supporting embankments and slopes, retaining walls, and drainage structures respectively to be constructed therein; and shall be kept and used for all lawful purposes including, but not limited to constructing, reconstructing, maintaining, operating and repairing the roadway.

 

The abutter's rights of direct access shall be taken where indicated to completely and unequivocally remove the right of ingress and egress to the permanent right-of-way from the adjacent property.

 

The permanent drainage easements shall be used by Kansas City for storm water drainage including the right to build, construct, keep and maintain storm water drainage facilities; and there shall not be built thereon or thereover any structure which may interfere with the maintenance and use of said storm water drainage facilities and appurtenances.

 

The Temporary Construction Easements shall be used by Kansas City or its authorized agents, servants, employees or contractors during construction for grading and sloping, construction of driveway pavements, removal of structures, draining, mucking and filling a pond, (where stated), removal and replacement of fencing, removal of trees and shrubbery, utility construction work, the storage of materials, the operation of equipment, and the movement of a working force. After the work is complete, Kansas City shall cause the surface of lands lying within said temporary easements to be restored to substantially the same physical condition that existed at the time Kansas City or its agents entered upon it. Said temporary construction easements shall terminate upon completion and acceptance of the improvements by the Director of Public Works and/or the State District Engineer.

 

Tract No. 3 (B) - Permanent Street Right-of-Way, Abutter's Rights of Direct Access, Permanent Drainage Easements, and Temporary Construction Easement

 

A Permanent Street Right-of-Way for both Relocated Route 150 and Relocated 135th Street over: All that part of owner's real property and real property rights and interests within the limits indicated, said property lying on both the right or Westerly and left or Easterly sides of the following described Route 150 relocated centerline and the relocated 135th Street centerline; containing 23.59 acres, more or less, of new limited access land.

Abutters' Rights of Direct Access:

 

Also, all abutter's rights of direct access between the highway now know as Relocated Route 150 and grantor's abutting land in the North of the SE and the SE SE of Section 19, and the NE NE of Section 30, all in T47N, R33W, Jackson County, Missouri, except that there is reserved and excepted to grantor, its successors and assigns the usual right of direct access (a) to any adjacent outer roadway if and while it may be maintained by proper authority in front of said land, and (b) along it to and from the nearest lane of the thruway or public highway, and (c) at all times when no outer roadway is being so maintained, there is reserved and excepted to grantors the usual right of direct access to the nearest lane of the thruway over a 20 foot entrance which shall be constructed by the Commission. Said entrance is to be centered at the Westerly right-of-way line opposite Station 28+50. Grantors reserve the right to widen said above-described entrance to a maximum width of 60 feet at their own expense. Such widening shall be in accordance with a permit issued by Commission on application by grantors, its successors and assigns. Also there is reserved and excepted to grantors the usual right of direct access to the nearest lane of the thruway over an entrance not to exceed 60 feet to be centered at the Westerly right-of-way line opposite Station 13+40. The cost of constructing said entrance shall be borne by the grantor and shall be in accordance with a permit issued by the Commission on application by grantor, its successor and assigns.

 

Permanent Drainage Easements:

 

Also, two permanent easements for the purpose of constructing drainage controls which includes all that part of grantor's real property and real property rights and interests located in the SE SE of Section 19, T47N, R33W, Jackson County, Missouri, hereinafter designated as Parcels 1 and 2; containing 0.47 of an acre, more or less, of land.

 

Permanent Drainage Easement No. 1

 

Said parcel is described as lying within the widths on the right or Westerly side of the above described Route 150 relocated centerline, to wit: An even width of 300 feet between Station 25+59.28 and Station 26+60.39.

 

Permanent Drainage Easement No. 2

 

Said parcel is described as lying within the widths on the left or Easterly side of the above described Route 150 relocated centerline, to wit: An even width of 300 feet between Station 25+00 and Station 26+00.

 

The drainage controls will be constructed on only part of said land, the extra land being included for workers and machinery to be utilized. After completion of construction of the drainage controls, the owners of said land may fence, and shall have the free and uninterrupted possession and use of said property; subject only to the Missouri Highway and Transportation Commission's right, if it should so elect to enter thereon from time to time for the purpose of maintaining said drainage controls.

 

Temporary Construction Easement:

 

Also, temporary easements over and across three tracts of land hereinafter designated as Parcels A, B and C; containing 2.25 acres, more or less, of land.

 

Temporary Construction Easement - Parcel A: a temporary easement for the purpose of grading, sloping and construction of an entrance which includes all that part of grantor's land located in the NE SE of Section 19, T47N, R33W, Jackson County, Missouri, lying within the widths on the right or Southwesterly side of the above described Route 150 relocated centerline, to wit: An even width of 250 feet between Station 12+30 and Station 14+30.

 

Temporary Construction Easement - Parcel B: a temporary easement for the purpose of draining, mucking and filling a pond which includes all that part of grantor's land located in the NE SE of Section 19, T47N, R33W, Jackson County, Missouri, lying on both the right or Southerly and left or Northerly sides of the above described Relocated 135th Street centerline, to wit: Beginning at a point 153.5 feet left of Station 1+22; thence Northeasterly to a point 200 feet left of Station 4+53.4; thence Easterly to a point 114.14 feet left of Station 5+56.07; thence Southeasterly, crossing the Relocated 135th Street centerline, to a point 129.8 feet right of Station 6+35; thence Southwesterly to a point 220 feet right of Station 3+70; thence Southwesterly to a point 250 feet right of Station 1+94; thence Southwesterly to a point 250 feet right of Station 0+86.5; thence Northwesterly, crossing the Relocated 135th Street centerline, to the point of beginning.

 

Temporary Construction Easement - Parcel C: Parcel C, a temporary easement for the purpose of grading, sloping and construction which includes all that part of grantor's land located in the NE 1/4 NE 1/4 of Section 30, T47N, R33W, Jackson County, Missouri, lying on the left or Easterly side of the above described Route 150 relocated centerline, to wit: Beginning at a point 166.80 feet left of Station 44+18.98; thence Northeasterly to a point 487.56 feet left of Station 40+68.15; thence Southeasterly, crossing the existing Wyandotte centerline, to a point 610.96 feet left of Station 41+80.38; thence Southwesterly to a point 434.51 feet to left of Station 44+76.13; thence Southwesterly to a point 160 feet left of Station 47+18.48; thence Northwesterly, crossing the existing Wyandotte centerline, to the point of beginning.

 

Upon completion and acceptance of the project, the easement rights in said temporary easements designated Parcels A, B and C, shall cease and be no longer in effect.

A Permanent Street Right-of-Way over: All that part of owners real property and real property rights and interest within the limits indicated, located in the East of the NE , Section 30, T47N, R33W, Kansas City, Jackson County, Missouri, including portions of Lot 2, "Bi-State Business Park" and Lots 37 and 43 of "Bi-State Business Park, Second Plat", both subdivisions of record in Kansas City, Jackson County, Missouri, hereinafter designated as lying on both the left or Easterly and right or Westerly sides of the following described Route 150 relocated centerline, containing 9.33 acres, more or less, of new limited access land.

Grantor, its successor and assigns reserves the right of a 60-foot wide ingress and egress easement to use as a livestock and equipment underpass underneath the relocated Route 150 bridge centered at Station 56+00; however the right of ingress and egress excludes all the area occupied or to be occupied by the relocated Route 150 bridge, all the space above it, all the space below it to a horizontal plane having an elevation of 880 feet above mean sea level, United States Geodetic Survey datum, and all the space occupied or to be occupied by supports and foundations of said bridge structure. Said line of ingress and egress being applicable only from present ground level up to said horizontal plane having an elevation of 880 feet above mean sea level, United States Geodetic Survey datum.

 

Temporary Construction Easement:

 

Also, three temporary easements hereinafter designated as Tracts A, B and C.

 

Tract A, a temporary easement for the purpose of grading, sloping and construction which includes all that part of grantor's land located in the NE 1/4 NE 1/4 of Section 30, T47N, R33W, Kansas City, Jackson County, Missouri, lying on the left or Easterly side of the above described Route 150 relocated centerline, to wit: Beginning at a point 166.80 feet left of Station 44+18.98; thence Northeasterly to a point 487.56 feet left of Station 40+68.15; thence Southeasterly, crossing the existing Wyandotte centerline, to a point 610.96 feet left of Station 41+80.38; thence Southwesterly to a point 434.51 feet left of Station 44+76.13; thence Southwesterly to a point 160 feet left of Station 47+18.48; thence Northwesterly, crossing said existing Wyandotte centerline, to the point of beginning; containing 0.83 of an acre, more of less, of land, excepting therefrom that portion within the existing right-of-way of Wyandotte Street.

Upon completion and acceptance of the project, the easement rights in said temporary easements designated Tract A, B and C, shall cease and be no longer in effect.

The drainage controls will be constructed on only part of said land, the extra land being included for workers and machinery to be utilized. After completion of construction and acceptance of the drainage controls, the owners of said land may fence, and shall have the free and uninterrupted possession and use of said tract; subject only to the Missouri Highway and Transportation Commission's right, if it should so elect, to enter thereon from time to time for the purpose of maintaining said drainage controls.

A width of 135 feet at Station 107+00; thence increasing uniformly to a width of 352 feet at Station 112+60; thence decreasing uniformly to a width of 322.5 feet at Station 114+32; thence increasing uniformly to a width of 373.59 feet at Station 118+57.78; thence increasing uniformly to a width of 383.27 feet at Station 119+41.68.

 

Abutters' Rights of Direct Access:

 

Also all abutters' rights of direct access between the highway now known as relocated Route 150, including Ramp 2 and owners' abutting land in said Lots 1 and 2.

 

Tract No. 22 - Permanent Street Right-of-Way and Abutters' Rights of Direct Access A Permanent Street Right-of-Way over:

 

All that part of owners' real property and real property rights and interests within the limits indicated, said property lying within the widths on the left or Easterly side of the following described Route D centerline, to wit: An even width of 500 feet between Station 240+00 and Station 240+58; thence decreasing uniformly to a width of 209.39 feet at Station 242+52.38; thence decreasing uniformly to a width of 140 feet at Station 243+00; containing 0.87 of an acre, more or less, of new land.

 

Owners said real property is described as:

 

A tract of land in the Northeast of the Northeast of Section 32, and in the Northwest of the Northwest of Section 33, all in Township 47, Range 33, Kansas City, Jackson County, Missouri, more particularly described as follows: Commencing at the Southeast corner of the Northeast of the Northeast of said Section 32; thence along the East line of said section North 0003' East 962.17 feet to the true point of beginning of this tract; thence South 81015' West 16.54 feet; thence South 73013'34" West 442.24 feet to a point on the East right-of-way line of relocated Holmes Road, said point being 140 feet East of centerline Station 244+50; thence along the East right-of-way line parallel to and 140 feet East of said centerline North 0028' East 350 feet to a point opposite centerline Station 241+00, said point being on the South right-of-way line of Missouri Highway No. 150 (140 feet South of said Highway centerline); thence along the South right-of-way line of said Missouri Highway No. 150 North 81042'42" East 263.26 feet to a point 100 feet South of centerline Station 46+00; thence continuing along the South right-of-way line of said highway parallel to and 100 feet South of said centerline South 89047'50" East 178.07 feet to a point on the East line of said section, said point being on the West line of the Northwest of the Northwest of said Section 33, said point being also 90.44 feet South of the Northeast corner of said Section 32 and the Northwest corner of said Section 33; thence continuing along the South right-of-way line of said highway, parallel to and 100 feet South of said centerline South 89047'50" East 164.03 feet; thence leaving said highway right-of-way line South 0001'30" East 231.07 feet; thence South 81015' West 167.75 feet to the true point of beginning.

 

The Route D centerline is located and described as follows:

 

Commencing at the Northeast corner of Section 29, T47N, R33W; thence South 10026'03.9" West a distance of 4,731.98 feet to a point on said centerline at Station 234+21.05; thence the centerline extends South 03049'21" West a distance of 780.02 feet to Station 242+01.07 which equals Station 0+00 on the S.E. Outer Road centerline as hereinafter referenced; thence the Route D centerline continues South 03049'21" West a distance of 220 feet to Station 244+21.07.

 

The S.E. Outer Road centerline is located and described as follows:

 

Commencing at Station 0+00 as above referenced; thence the centerline extends North 75049'21' East a distance of 168.14 feet to Point of Curve Station 1+68.14, which is the beginning of a 12030' curve to the left with an interior angle of 21058'20"; thence Northeasterly along said curve a distance of 175.78 feet to Point of Reverse Curve Station 3+43.92.

 

Abutters' Rights of Direct Access:

 

Also, all abutters' rights of direct access between the highway now known as relocated Route 150, including Ramp 4 and owners' abutting said land; except that there is reserved and excepted to owners', their heirs, and assigns the usual right of direct access (a) to any adjacent outer roadway if and while it may be maintained by proper authority in front of said land, and (b) along it to and from the nearest lane of the throughway or public highway.

 

This conveyance is made upon the express condition and understanding that the Commission will construct and maintain such an adjacent outer roadway fronting owner's land on the right or Southerly side of the relocated Route 150 highway. Access is limited to the outer roadway (S.E. Outer Road) from Station 0+00 to Station 1+80 on the S.E. Outer Road centerline.

 

Also, all abutters' rights of direct access between Route D and owners' abutting land from Station 240+00 to Station 244+21.07 in said Northeast Northeast Section 32, T47N, R33W, Kansas City, Jackson County, Missouri.

 

Section 9. Utilities. That in widening said street, certain public utility corporation easements may be included within the boundaries of the lands acquired for permanent easements described herein, and in that regard, Kansas City reserves unto such public utility corporations the right to keep and maintain such physical improvements now located within such easements in conformance with the street improvement to be made by the City. Where no such physical improvements are presently located within such easements, said corporations shall have the right to locate, construct and maintain their respective improvements, subject, however, to the rights acquired herein by the City to construct and maintain the street improvements within the limits of the said lands acquired for permanent easements described herein, and in conformance with the re-established grades of the street improvements.

 

Section 10. Compensation. Just compensation for the private property to be condemned and taken for permanent easements as aforesaid and such damages as may be found to accrue by reason of the grading of said streets and for the taking of the temporary construction easements, shall be assessed and paid in one or more proceedings in the manner provided by Articles VI and VII of the Charter of Kansas City, or by the provisions of Rule 86 of the Rules of Civil Procedure, or by any other method authorized by law; and the proceedings therefore shall be instituted in the Circuit Court of Jackson County, Missouri. The compensation to be paid for the taking or damaging of the property shall be paid from funds now available or to be made available.

 

Section 11. Partial Dismissal. If any lands or easements as aforesaid shall be acquired by the Chief Negotiator for the Missouri Department of Transportation which he is hereby authorized to do prior to or during pendency of the condemnation proceedings, the City Attorney is hereby authorized to withdraw such land or easement from such condemnation proceedings.

 

This ordinance is recommended for passage by the Director of Public Works.
