ORDINANCE NO. 030846

 

Approving a General Development Plan for the Union Hill Planning Area for an area of approximately 4.7 acres generally bounded by 27th Street on the north, 30th Street on the south, Gillham Road on the east and McGee Trafficway on the west; declaring the area included in such plan to be a blighted, insanitary or undeveloped industrial area and its redevelopment necessary; and approving the ad valorem tax benefits.

 

WHEREAS, the Planned Industrial Expansion Authority of Kansas City, Missouri did prepare or cause to be prepared a General Development Plan for the Union Hill Planning Area and recommended that the Council approve the finding of blight and approve the General Development Plan for the area; and

WHEREAS, the City Plan Commission has reviewed and recommended approval of the finding of blight and of the General Development Plan for the Union Hill Planning Area on June 3, 2003, as evidenced by its resolution and has found said plan to be in conformance with the general plan for the development of the community as a whole, a copy of which resolution is attached hereto and incorporated herein by reference as Exhibit "A"; and

 

WHEREAS, Section 100.400, RSMo, authorizes the Council to approve a general development plan and a designation of blight if the Council finds that the plan is feasible and in conformity with the general plan for the development of the community as a whole; and

 

WHEREAS, the Council has determined that ad valorem tax exemption benefits as authorized in Section 100.570, RSMo are necessary to attract developers to the area; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the Council declares the area of approximately 4.7 acres generally bounded by 27th Street on the north, 30th Street on the south, Gillham Road on the east and McGee Trafficway on the west, and more specifically described as follows:

2921 McGee Trafficway: The west 120.5 feet of Lot 1, Block 4, t he west 120.5 feet of Lots 2, 3, 4, 5, 6 and 7, the west 120.5 feet (except part in trafficway) of Lot 89, 10 and 11, all lying north and east of trafficway and west of Gillham Road, Coleman Place, a subdivision in Kansas City, Jackson County, Missouri.

 

414 E. 29th Street: The east 120.25 feet of Lots 1-14, Block 9 and the south one-half of vacated 28th Street north and adjacent, Cont of Hoelzels Addition, a subdivision in Kansas City, Jackson County, Missouri.

 

2745 McGee Trafficway: Lots 1-19 and 22-32, Block 10 (except parts in streets) and all vacated alleys, Cont of Hoelzels Addition, a subdivision in Kansas City, Jackson


County, Missouri.

 

2834 McGee Trafficway: The west 11 feet, Lot 17, all Lots 18 and 19, Block 9, Cont of Hoelzels Addition, of, a subdivision in Kansas City, Jackson County, Missouri.

 

2816 McGee Trafficway: All of Lots 20 and 21 and west 11 feet of Lot 22, Block 9 (except north 21.94 feet p/m), Cont of Hoelzels Addition, a subdivision in Kansas City, Jackson County, Missouri.

 

2800 McGee Trafficway: The north 21.94 feet of Lots 20 and 21 and the north 21.94 feet of the west 11 feet of Lot 22 and vacated alley lying north and adjacent and the west 11 feet of Lot 27 and all of Lots 28 and 29, Block 9 and the south one-half vacated 28th Street lying north and adjacent, Cont of Hoelzels Addition, a subdivision in Kansas City, Jackson County, Missouri.

 

2760 McGee Trafficway: All lying south and west of McGee Trafficway of Lots 20 and 21, Block 10 and vacated Oak Street lying west and adjacent and the north one-half of vacated 28th Street lying south and adjacent, Cont of Hoelzels Addition, a subdivision in Kansas City, Jackson County, Missouri.

 

2734 McGee Trafficway, Section 17, Township 49, Range 33, Hoelzels Addition, beginning intersection C north line vacated Grauman Street and west line McGee Trafficway; thence northwesterly 73 feet; thence southerly 42.5 feet; thence southeasterly 171.22 feet to E. Linwood, Northwest 1/4 of Section; thence east 55 feet to west line McGee Trafficway; thence northwesterly 125 feet to beginning point of Lots 1 and 2, Block 11, Hoelzels Addition, a subdivision in Kansas City, Jackson County, Missouri.

 

2735 McGee Trafficway: The part of Lots 1 and 2 lying east of McGee Street Trafficway, Block 11, Cont of Hoelzels Addition, a subdivision in Kansas City, Jackson County, Missouri.

 

to be a blighted, insanitary or undeveloped industrial area in need of industrial development as defined in Section 100.310, RSMo, which constitutes an economic or social liability or a serious and growing menace, which is injurious to the public health, safety, morals, economy and welfare of the residents of Kansas City, and finds that the elimination or prevention of the detrimental conditions in such area by the commercial development of such area is necessary and in the interest of the public health, safety, morals, economy and welfare of such residents.

Section 2. That the General Development Plan for the Union Hill Planning Area being that area of approximately 4.7 acres generally bounded by 27th Street on the north, 30th Street on the south, Gillham Road on the east and McGee Trafficway on the west, is hereby approved. A copy of said plan is attached hereto and incorporated herein by reference as Document No. 030846.

Section 3. That the Council has duly made the findings necessary for compliance with Section 100.300-100.620, RSMo.

Section 4. That said General Development Plan is hereby found to be feasible and in conformance with the general plan for the development of the community as a whole.

Section 5. That the ad valorem tax exemption benefits as authorized in Section 100.570, RSMo, are hereby extended to the plan area to the extent and in the manner as provided for in said General Development Plan.
