Approving an amendment to a previously approved Community
Unit Project on an approximately 2.3 acre tract of land generally located at
the southeast corner of N.E. Barry Road and N. Troost Avenue. (9947-CUP-3)
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That an amendment to a previously
approved Community Unit Project on an approximately 2.3 acre tract of land
generally located at the southeast corner of N.E. Barry Road and N. Troost
Avenue, and more specifically described as follows:
A tract of land in the Southwest Quarter of Section
12, Township 51, Range 33, Kansas City, Clay County, Missouri, more fully
described as follows: Beginning at the northwest corner of the Southwest
Quarter of said Section 12; thence South 88 02'42" East along the
north line of said Quarter Section, 296.00 feet; thence South 0
37'02" West, parallel to the west line of said Quarter Section, 36.46 feet
to the true point of beginning; thence South 0 37'02" West, parallel
to the west line of said Quarter Section and partially along the west line
of Dolce Estates, a subdivision of land in said Kansas City, 494.00 feet
to the southwest corner of said Dolce Estates, also a point on the north
line of Dolce Estates, Third Plat, also a subdivision of land in said
Kansas City; thence South 71 51'35" West, along the northerly line of
said Dolce Estates, Third Plat, 90.44 feet; thence North 89 04'00"
East, along the northerly line of said Dolce Estates, Third Plat, 24.33
feet to the northwest corner of said plat; thence South 0 37'02" West
along the west line of said Dolce Estates, Third Plat, 173.29 feet to a
point on the north line of Jim Horner Estates; a subdivision of land in
said Kansas City; thence North 87 48'54" West along the north line of
said Jim Horner Estates, 156.01 feet to the east line of N. Troost Avenue;
thence North 0 37'02" East, parallel and 30.00 feet east of the west
line of said Quarter Section, 698.97 feet to the south line of N.E. Barry
Road; thence South 88 02'42" East, parallel to the north line of said
Quarter Section, 265.99 feet to the point of beginning. Contains 3.80 acres,
more or less.
is hereby approved, subject to the following conditions:
1. That the developer cause the area to be platted
and processed in accordance with Chapter 66, Code of Ordinances of
the City of Kansas City, Missouri, as amended,
commonly known as the Subdivision Regulations.
2. That the developer submit a storm drainage
study to the City Engineer's Office for approval and that the
developer construct any improvements as required by the City
Engineer's Office.
3. That the developer submit plans for grading and
siltation and erosion control to the City Engineer's Office for
approval prior to beginning any construction activities.
4. That the developer widen the east half of N.
Troost Avenue to collector street standards for the entire frontage
as required by the Department of Public Works,
including curb, gutter, sidewalk and
streetlights.
5. That the developer extend the declarations and
restrictions as required by the Department of Public Works.
6. That the developer extend and construct
sanitary sewers as required by the Department of Public Works.
7. That the developer extend water mains as
required by the Water Services Department.
8. That the developer provide for fire protection
and install hard surface roads prior to construction beyond
foundations as required by the Fire Department.
9. That the developer contribute $2,060.11 in lieu
of parkland dedication for 16 units in satisfaction of Section 66-128
of the Subdivision Regulations.
10. That the developer obtain a certificate of
survey for approval by the City prior to the sale of individual
units.
11. That the developer submit a final plan to the
City Plan Commission for approval, including plans for landscaping
and grading.
A copy of said Community Unit Project amendment is on
file in the office of the City Clerk under Document No. 971211, which is
attached hereto and made a part hereof.
Section B. That the Council finds and declares that
before taking any action on the proposed Community Unit Project amendment
hereinabove, all public notices and hearings required by the Zoning Ordinance
have been given and had.
