ORDINANCE NO. 160339

 

Approving a development plan to allow for the expansion of the Harvester’s Community Food Network facilities on about 10.85 acres generally located on either side of Topping Avenue, just south of Leeds Trafficway, with an address of 3801 Topping Avenue in District M1-5. (14656-P-1)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a development plan to allow for the expansion of the Harvester’s Community Food Network facilities on about 10.85 acres generally located on either side of Topping Avenue, just south of Leeds Trafficway, with an address of 3801 Topping Avenue in District M1-5 (Manufacturing 1 (dash 5)), and more specifically described as follows:

 

Tract I: All of Lots 1 through 60, all inclusive, except the South 10 feet of Lots 1, 30, 31 and 60, and the West 43.06 feet of Lots 61 through 75, all inclusive, except the South 10 feet of Lot 61, Dunbar Heights, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof together with that portion of vacated White Avenue East of and adjoining Lots 46 to 60 and West of and adjoining Lots 61 to 75 as vacated by Ordinance No. 21742 and that portion of vacated Bellaire Avenue East of and adjoining Lots 16 to 30 and West of and adjoining Lots 31 to 45 as vacated by Ordinance No. 21742, together with that portion of vacated 39th Street, lying South of and adjoining to Lots 1, 30, 31, 60 and 61, as vacated by Ordinance No. 950567, being described as follows: Commencing at the Southwest corner of the Northwest Quarter of Section 24, Township 49, Range 33, Kansas City, Jackson County, Missouri; thence North 86 South line of said Northwest Quarter, 30.00 feet to the South prolongation of the East line of Topping Avenue, as now established, said point also being the True Point of Beginning of the tract to be herein described; thence North 03 degrees 13 minutes 23 seconds West, along said East right-of-way line and its South prolongation, 627.96 feet to its intersection with the South line of vacated 38th Street; thence North 86 degrees 54 minutes 06 seconds East, along the South line of said vacated 38th Street, 626.13 feet to a point 43.06 feet East of the Northeast corner of Lot 75, said Dunbar Heights; thence South 03 degrees 13 minutes 23 seconds East, parallel with and 43.06 feet East of the East line of vacated White Avenue and its South prolongation, 627.96 feet to a point on the South line of said Northwest Quarter; thence South 86 degrees 54 minutes 06 seconds West, along said South line, 626.13 feet to the true point of beginning.

 

Tract II: All that part of the Southeast Quarter of the Northeast Quarter of Section 23, Township 49, Range 33, in the City of Kansas City, Jackson County, Missouri, described as follows: Commencing at the Southeast corner of the Southeast Quarter of said Northeast Quarter; thence South 86 degrees 53 minutes 09 seconds West along the South line of the Southeast Quarter of said Northeast Quarter, a distance of 30.00 feet to the West right-of-way line of Topping Avenue, as now established and to the True Point of Beginning; thence North 03 right-of-way line, a distance of 658.97 feet to the Centerline of vacated 38th Street; thence South 86 West along the Centerline of said vacated 38th Street, a distance of 120.00 feet; thence South 03 a distance of 658.97 feet to a point in the South line of the Southeast Quarter of said Northeast Quarter; thence North 86 degrees 53 minutes 09 seconds East along South line, a distance of 120.0 feet to the point of beginning. Also, described as Lot 2, in the Certificate of Survey filed as Document No. K-1185084, in Book S-5, at Page 14, in the Office of the Recorder of Deeds of Jackson County, at Kansas City, Missouri.

 

is hereby approved, subject to the following conditions:

 

1.                  That the developer submit a storm drainage analysis from a Missouri licensed civil engineer to the Land Development Division, in accordance with adopted standards, including a BMP level of service analysis prior to approval and issuance of any building permits, and that the developer secure permits to construct any improvements as required by the Land Development Division prior to issuance of a temporary or final certificate of occupancy.

 

2.                  That the developer submit construction plans in compliance with adopted standards for all improvements required for the mid-block crosswalk, and shall secure permits for those improvements as required by the Land Development Division, prior to issuance of a temporary or final certificate of occupancy.

 

3.                  That the developer submit verification of vertical and horizontal sight distance for the drive connection to public right-of-way to the Land Development Division and make improvements to ensure local jurisdiction and/or minimum AASHTO adequate sight distance standards are met, prior to issuance of any certificate of occupancy.

 

4.                  That the developer submit a letter to the Land Development Division from a licensed civil engineer, licensed architect, or licensed landscape architect, who is registered in the State of Missouri, identifying sidewalks, curbs, and gutters in disrepair as defined by Public Works Department's "OUT OF REPAIR CRITERIA FOR SIDEWALK, DRIVEWAY AND CURB revised 4/8/09" and based on compliance with Chapters 56 and 64, Code of Ordinances, for the sidewalks, curbs, and gutters where said letter shall identify the quantity and location of sidewalks, curbs, and gutters that need to be constructed, repaired, or reconstructed to remedy deficiencies and/or to remove existing approaches no longer needed by this project. The developer shall secure permits to repair or reconstruct the identified sidewalks, curbs, and gutters as necessary along all development street frontages as required by the Land Development Division and prior to issuance of a temporary or final certificate of occupancy.

 

5.                  That the owner/developer submit plans for grading, siltation, and erosion control to the Land Development Division for review and acceptance, and secure a site disturbance permit for any proposed disturbance area equal to one acre or more prior to beginning any construction activities.

 

6.                  That the developer secure permits to extend the public storm water conveyance system from Topping Avenue to the east as shown on the development plan as required by the Land Development Division, prior to issuance of a storm sewer permit.

 

7.                  That the developer grant a BMP Easement to the City as required by the Land Development Division, prior to issuance of a temporary or final certificate of occupancy.

 

8.                  That the developer grant a Surface Drainage Easement from end of proposed public storm sewer to the Blue River, to the City as required by the Land Development Division, prior to issuance of storm sewer permit.

 

A copy of said development plan is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed development plan hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
