ORDINANCE NO. 030305

 

Approving a Community Unit Project on an approximately 11.82 acre tract of land generally located on the north side of N.W. 68th Street and N. Pontiac Avenue (extended). (12812-CUP)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a Community Unit Project on an approximately 11.82 acre tract of land generally located on the north side of N.W. 68th Street and N. Pontiac Avenue (extended), and more specifically described as follows:

 

Commencing at the southwest corner of the Northeast Quarter of Section 21, Township 51 North, Range 33 West, Kansas City, Platte County, Missouri, thence east on the south line of said Northeast Quarter South 89E12'36" East, 411.66 feet; thence North 0E42'07" East, 59.86 feet to the north right of way line of N.W. 68th Street, said point being the point of beginning; thence North 0E42'07" East, 1247.51 feet; thence South 89E17'50" East, 411.66 feet; thence South 0E42'07" West, 1230.71 feet to the north right of way line of N.W. 68th Street, said point being 77.29 feet north from as measured perpendicular to the south line of said Northeast Quarter; thence southwesterly on a curve to the left on said north right of way line (said curve having a radius of 10,050 feet, central angle of 1E31'44") an arc distance of 269.50 feet, an initial tangent bearing of North 89E23'59" East, thence continuing on said north right of way South 87E51'48" West, 142.52 feet to the point of beginning. Tract contains 11.70 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineers Office for approval when the first final plat is submitted and that the developer construct any improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

4. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

5. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.


6. That the developer construct sidewalks along the street frontage of the detention tract as required by the Department of Public Works.

 

7. That the developer construct an off-site cul-de-sac as required by the Department of Public Works.

 

8. That the developer construct hard surface streets and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

9. That the developer submit declarations of covenants and bylaws to the Law Department for approval.

 

 

10. That the developer submit a street tree planting plan as part of the final plat with a copy to be submitted to the Department of City Development, secure the approval of the City Forester for street trees planted on right of way in front of residential lots, and plant the street trees in conformance with the plan approved by the City Forester. The plan shall include size, type, species and placement of trees.

 

11. That the developer secure the approval of the Street Naming Committee for all street names prior to submittal of the final plat.

 

12. That the developer contribute $10,619.15 in lieu of parkland dedication for 42 single family lots (42 x 3.7 x .006 x $11,389.05) in satisfaction of Section 66-128 of the Subdivision Regulations.

 

13. That the developer receive the approval of the Board of Zoning Adjustment for any signs.

 

14. That the developer extend N.W. 69th Place off-site to the west to the existing N.W. 69th Place with the final plat as required by the Department of Public Works.

 

15. That the developer extend water mains as required by the Water Services Department.

 

16. That the developer extend sanitary and/or storm sewers and determine adequacy as required by the Department of Public Works.

 

18. That the developer provide no direct access from N.W. 68th Street for Lots 1 and 42 with the final plat as required by the Department of Public Works.

 

19. That a waiver to the maximum lot depth to lot width ratio of 3:1 be granted for Lot 39.

 

20. That the developer submit a final plan to the City Plan Commission for approval including plans for landscaping, grading, fencing and wall construction on the detention tracts.

 

A copy of said Community Unit Project plan is on file in the office of the City Clerk under Document No. 030305, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
