ORDINANCE NO. 180819

 

Approving an amendment to the Blue Valley Urban Renewal Plan for the purpose of extending its duration for an additional fifteen year term.

 

WHEREAS, the Land Clearance for Redevelopment Authority of Kansas City, Missouri (“LCRA”) is a public body corporate and politic created by the Land Clearance for Redevelopment Authority Law, Section 99.300, et seq., RSMo (“LCRA Law”), and is transacting business and exercising the powers granted by the LCRA Law by virtue of Committee Substitute for Ordinance No. 16120; and

 

WHEREAS, the LCRA approved the Blue Valley Urban Renewal Plan (“Plan”) on July 25, 1997, by Resolution 97-38; and

 

WHEREAS, the City Council approved the Plan on August 27, 1998, by Ordinance No. 980946; and

 

WHEREAS, the Plan, as originally approved by the City Council, provided that it would continue for a period of twenty years, i.e., until on or about August 27, 2018; and

 

WHEREAS, the City owns certain property within the Blue Valley Urban Renewal Area, (“City Property”); and

 

WHEREAS, Yana Properties, LLC, d/b/a Blue Nile Contractors, Inc., (“Developer”) desires to acquire a portion of the City Property to redevelop the site for its new corporate office and storage yard (“Project”); and

 

WHEREAS, the City Council authorized the Director of General Services to negotiate, enter into and implement a Purchase Agreement with the LCRA to transfer a portion of the City Property to it in furtherance of the Project; and

 

WHEREAS, to provide LCRA the authority it needs to acquire a portion of the City Property, transfer the same to the Developer, and enter into the redevelopment agreement with the Developer, the Plan should be extended for an additional fifteen years; and

 

WHEREAS, the LCRA anticipates acting to extend the Plan at its October 24, 2018 meeting; and

 

WHEREAS, the LCRA Law and Plan require that the City Council act with respect to such amendment, should it elect to approve the same; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That Section 10 of the Blue Valley Urban Renewal Plan, as the same was previously approved by the City Council via Ordinance No. 980946, is hereby amended to read as follows:

 

X. DURATION OF CONTROLS

 

This Urban Renewal Plan shall be effective for a period of thirty-five (35) years from the date of approval by the City Council of the City of Kansas City, Missouri, of Ordinance No. 980946 on August 27, 1998, unless otherwise amended by the City, with a current termination date of August 27, 2033.
