Amending Chapter 64, Code
of Ordinances, by repealing Sections 64-41, Deposit and fees for vacation of
street or public place, and 64-42, Fee for vacation of subdivision plat or
addition, and enacting in lieu thereof two new sections of like numbers and
subject matters.
BE IT ORDAINED BY
THE COUNCIL OF KANSAS CITY:
Section 1. That
Chapter 64, Code of Ordinances of the City of Kansas City, Missouri, is hereby
amended by repealing Sections 64-41, Deposit and fees for vacation of street or
public place, and 64-42, Fee for vacation of subdivision plat or addition, and
enacting in lieu thereof two new sections of like numbers and subject matters,
to read as follows:
Sec. 64_41. Deposit and
fees for vacation of street or public place.
(a) Whenever any
person shall file a petition for the vacation of any street or public place
within the city, he shall procure from the director of records a written
estimate of the cost of publication and all other expenses incident to such
vacation, and shall, before the notice of the pendency of such petition is
published by the director of records, deposit with the commissioner of accounts
a sum of money equal to the amount of such estimate, which money shall be kept
and paid out as provided in this section.
(b) In addition
to the deposit required in subsection (a) of this section, a fee in the amount
of $150.00 for the vacation of any street or alley shall be paid to the City at
the time of application.
The United States of America
or any of its agencies shall be exempt from payment of the fee as prescribed in
this subsection.
Sec. 64_42. Fee for
vacation of subdivision plat or addition.
(a) Whenever any
person shall file a petition for the vacation of an addition or subdivision of
land, including all streets and alleys within the subdivision, he shall procure
from the director of records a written estimate of the cost of publication and
all other expenses incident to such vacation, and shall before the notice of
the pendency of such petition is published by the director of records, deposit
with the commissioner of accounts a sum of money equal to the amount of such
estimate, which money shall be kept and paid out as provided in this section.
(b) In addition
to the deposit required in subsection (a) of this section, a fee in the amount
of $150.00 for the vacation of an addition or subdivision of land, including
all streets and alleys within the subdivision shall be paid to the City at the
time of application. The United States of America or any of its agencies shall
be exempt from payment of the fee as prescribed in this subsection.
