ORDINANCE NO. 970878
Approving a change in the Employment Contract with the
City Manager Larry Brown; accepting his resignation; authorizing the Mayor to
execute a Release and Severance Agreement with Larry Brown; transferring
$180,000.00 from the contingent appropriation of the General Fund to an account
in the Mayor's Office; designating requisitioning authority; and declaring an
emergency.
WHEREAS, the City Council did by Committee
Substitute for Ordinance No. 931373 approve an Employment Contract commencing
January 3, 1994, with Larry Brown, City Manager; and
WHEREAS, said Contract was subsequently amended by
Ordinance No. 951515; and
WHEREAS, both parties to the Contract agree that it
is in the best interests of the City Manager and the City to change said
Contract by novation to provide for different terms and conditions under said
Contract and to enter into a severance and release agreement; and
WHEREAS, the City Council determines that it is
necessary to resolve the issue of the management of the City, immediately, in
order to preserve the public peace, property, health, and safety; NOW,
THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section 1. That the Contract between the City and
Larry Brown, commencing January 3, 1994, as approved by Committee Substitute
for Ordinance No. 931373, and as further amended by Ordinance No. 951515, is
hereby changed by novation to the form of the Contract, in substantial form as
the document attached hereto as Exhibit A.
Section 2. That the City Council hereby accepts the
resignation of Larry Brown, effective June 30, 1997.
Section 3. That the Mayor is authorized to execute
a release and severance agreement with Larry Brown, in substantial form as the
document attached hereto as Exhibit B.
Section 4. That the sum of $180,000.00 is
transferred from the Contingent Appropriation of the General Fund,
98-100-017-9990-B, to the following account in the General Fund:
98-100-001-1008-B Employment
Separation $180,000.00
Section 5. That the Mayor is designated as
requisitioning authority for Account No. 98-100-001-1008-B.
Section 6. That this ordinance, providing for the
immediate preservation of the public peace, property, health and safety, is
hereby declared to be an emergency ordinance within the meaning of Section 15
of the City Charter and shall take effect immediately upon passage.

I hereby certify that there is a balance, otherwise
unencumbered, to the credit of the appropriation to which the foregoing
expenditure is to be charged, and a cash balance, otherwise unencumbered, in
the treasury, to the credit of the fund from which payment is to be made, each
sufficient to meet the obligation hereby incurred.
