Approving a Community Unit Project on approximately a
24.4 acre tract of land generally located at the northeast corner of Holmes
Road and 127th Street. (11875-CUP-1)
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That a Community Unit Project on
approximately a 24.4 acre tract of land generally located at the northeast
corner of Holmes Road and 127th Street, and more specifically described as
follows:
All of Lots 7, 8, 9, 10, 11, 12, and 13, Formella
Acres, a subdivision of land in Kansas City, Jackson County, Missouri, and
all that part of the Northeast Quarter of Section 17, Township 47, Range
33, Kansas City, Jackson County, Missouri, all being bounded and described
as follows: Commencing at the southeast corner of said Northeast Quarter;
thence North 85 26'47" West, along the south line of said Northeast
Quarter, 643,88 feet to a point on the westerly line of the Missouri Pacific
Railroad as now established, said point being the true point of beginning of
the tract to be herein described; thence continuing North 85 26'47"
West, along said south line, 459.82 feet to the southeast corner of the
aforementioned Formella Acres; thence North 8 01'22" East, along the
easterly line of said Formella Acres, 826.76 feet to the southeast corner
of Lot 13, said Formella Acres; thence North 87 01'44" West, along
the south line of said Lot 13, 243.52 feet to the southwest corner thereof;
thence North 3 24'22" East, along the westerly line of said Formella
Acres, 1044.08 feet to the northwest corner of Lot 7, said Formella Acres;
thence South 87 01'49" East along the north line of said Lot 7, 342.65
feet to a point on the westerly line of Mission Lake - Fifth Plat, a
subdivision of land in Kansas City, Jackson County, Missouri; thence South
3 11'22" West, along said westerly line, 109.73 feet to the southwest
corner of said Mission Lake - Fifth Plat; thence South 70 59'34"
East, along the southerly line of said Mission Lake - Fifth Plat, 221.79
feet; thence South 85 25'34" East, along said southerly line, 205.00
feet to a point on the westerly line of the aforementioned Missouri Pacific
Railroad; thence South 5 35'10" West, along said westerly line, 21.43
feet; thence North 84 24'50" West, along said westerly line, 25.00
feet; thence South 5 35'10" West, along said westerly line, 364.07 feet;
thence North 85 31'04" West, along said westerly line, 10.00 feet;
thence South 5 35'10" West, along said westerly line, 716.08 feet;
thence North 85 26'47" West, along said westerly line, 25.00 feet;
thence South 5 35'10" West, along said westerly line, 605.87 feet to
the true point of beginning. Containing 24.39 acres, more or less.
is hereby approved, subject to the following conditions:
1. That the developer cause the area to be platted
and processed in accordance with Chapter 66, Code of Ordinances of
the City of Kansas City, Missouri, as amended,
commonly known as the Subdivision Regulations.
2. That the developer submit a storm drainage
study to the City Engineer's Office for approval and that the developer
make any improvements as required by the City
Engineer's Office.
3. That the developer submit plans for grading and
siltation and erosion control to the City Engineer's Office for
approval prior to beginning any construction activities.
4. That the developer secure a land disturbance
permit from the Missouri Department of Natural Resources.
5. That the developer submit a street name sign
plan to the Street Naming Committee for approval prior to the
submittal of the first final plat.
6. That the developer extend water mains as
required by the Water Services Department.
7. That the developer construct hard surface
all-weather roads and provide for fire protection as required by the
Fire Department prior to construction beyond
foundations.
8. That the developer dedicate additional
right-of-way for Holmes Road as required by the Department of Public
Works so as to provide 50 feet of right-of-way as measured
from the centerline of Holmes Road.
9. That the developer improve one-half of Holmes
Road to primary arterial street standards as required by the
Department of Public Works.
10. That the developer secure the approval of the
Board of Zoning Adjustment for any variances prior to the issuance of
a building permit.
11. That the developer submit conditions, covenants
and restrictions to the Law Department for approval for the
maintenance of the private open space.
12. That the developer receive the approval of the
Department of City Development for a lot split prior to the sale of
any individual units.
13. That the developer contribute $21,870.55 in
lieu of parkland dedication for 144 units in satisfaction of Section
66-128 of the Subdivision Regulations.
14. That the developer submit a street tree
planting plan as part of the final plat to the City Forester for
approval and to the Department of City Development and secure the
approval of the City Forester for street trees
planted on right-of-way.
15. That the developer submit a final plan for
Tracts A and B as shown on the preliminary plan to the City Plan
Commission for approval including plans for landscaping prior
to the issuance of a building permit.
A copy of said Community Unit Project plan is on file in
the office of the City Clerk under Document No. 961595, which is attached
hereto and made a part hereof.
Section B. That the Council finds and declares that
before taking any action on the proposed Community Unit Project hereinabove,
all public notices and hearings required by the Zoning Ordinance have been
given and had.
