ORDINANCE NO. 130293

 

Amending the 2012 One Year Action Plan; authorizing submission of a Substantial Amendment to the U.S. Department of Housing and Urban Development; authorizing the Director of Neighborhoods and Housing Services to amend the City’s contract with Jazz District Redevelopment Corporation in an amount not to exceed $423,982.00 for the Highland Place Apartment Project; appropriating $125,000.00 from the Unappropriated Fund Balance in the Section 108 Loan Fund and $298,982.00 from the HOME Investment Fund; and designating requisitioning authority.

WHEREAS, on March 8, 2012, Council approved the City’s One Year Action Plan (“Plan”) through Committee Substitute for Resolution No. 120159; on July 12, 2012, Council approved Amendment No. 1 through Resolution No. 120591 to allocate funding to the Emergency Solutions Grant program; on March 21, 2013, Council approved Amendment No. 2 through Resolution No. 130188 to program funding for the Troost Avenue Reconstruction project; and Council authorized the submission of said Amendments to the U.S. Department of Housing and Urban Development (HUD); and

 WHEREAS, the submitted Amendments were prepared pursuant to and in accordance with Title I of the National Affordable Housing Act of 1990, as amended, as well as the appropriate administrative rules and regulations promulgated and adopted under such Act; and

WHEREAS, the City desires to revise the Plan in order to provide up to $423,982.00 in Section 108 and HOME Funds to make necessary improvements to the Highland Place Apartment Project (“Project”); and

WHEREAS, in order to reallocate and program this funding, the City must amend the One Year Action Plan; and

WHEREAS, the Project is a redevelopment project in the Historic 18th and Vine Jazz District which consists of the rehabilitation and conversion of the Rochester Hotel, located at 1821 Highland, and six residential homes, located at 1816-26 Highland, into 22 multi-family rental units to be leased to low-income Kansas City, Missouri residents; and

WHEREAS, the Project is nearly complete and has rehabilitated and saved six (6) historic structures in the Jazz District, all constructed in the late 1800s to early 1900s, which will help to maintain the District’s historic designation; and

WHEREAS, the City has established the renovation and preservation of the residential units and the related historic elements of the Highland Place as a priority; and

WHEREAS, the City has an obligation to HUD to complete the Highland Place project; and

WHEREAS, on April 28, 2011, the City Council approved Committee Substitute for Ordinance No. 110319 which accepted $2,300,000.00 in HOME funds from the Housing and Economic Development Financial Corporation’s (HEDFC) HOME program income account to provide partial financing for the project; and

WHEREAS, due to unforeseen site conditions associated with the rehabilitation of these historic homes, there are cost overruns associated with the Project; and

WHEREAS, the increased contract amount will provide a loan to the Jazz District Redevelopment Corporation (JDRC), the Project’s developer, to enable it to repay the construction financing loan; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the Substantial Amendment Number 3 to the 2012 One Year Action Plan, prepared pursuant to the National Affordable Housing Act of 1990, as amended, a copy of which in substantial form is attached hereto, is hereby approved.

Section 2. That the Mayor, on behalf of the City of Kansas City, Missouri, is hereby authorized to execute and submit the aforesaid Substantial Amendment Number 3 to the United States Department of Housing and Urban Development.  

Section 3. That the Director of Neighborhoods and Housing Services Department is hereby authorized to enter into a contract amendment with the Jazz District Redevelopment Corporation in an amount not to exceed $423,982.00.

 

Section 4. That the sum of $125,000.00 is hereby appropriated from the Unappropriated Fund Balance of the Section 108 Loan Fund to the following account:

 

14-2540-552095-B 18th & Vine $125,000.00

 

Section 5. That the revenue in the following account of the HOME Investment Fund is estimated in the following amount:

 

14-2940-550001-476050 Housing & Comm Dev Grant Rev $298,982.00

 

Section 6. That the sum of $298,982.00 is hereby appropriated from the Unappropriated Fund Balance of the HOME Investment Fund to the following account:

14-2940-555317-B-G55HOME12 Housing Development $298,982.00

 

Section 7. That the Director of Neighborhoods and Housing Services is designated as requisitioning authority for accounts 14-2540-552095 and 14-2940-555317.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
