ORDINANCE NO. 000033

 

Approving the plat of Oakwood Forest 3rd Plat, an addition in Kansas City, Platte County, Missouri; accepting various easements; establishing grades on public ways; accepting certain lands for park purposes forever, in accordance with Section 58 of Article III of the Charter of Kansas City.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the plat of Oakwood Forest 3rd Plat, a subdivision in Kansas City, Platte County, Missouri, a true and correct copy of which is attached hereto and incorporated herein by reference is hereby approved.

 

Section 2. That the plat granting and reserving unto Kansas City an easement and license or right to locate, construct, operate and maintain facilities including, but not limited to, water, gas, sewerage, telephone, cable TV, surface drainage, underground conduits, pad mounted transformers, service pedestals, any and all of them upon, over, under and along the strips of land outlined and designated on the plat by the words utility easement or U/E be and the same are hereby accepted and where other easements are outlined and designated on the plat for a particular purpose, be and the same are hereby accepted for the purpose as therein set out.

 

Section 3. That the grades of the streets and other public ways set out on the plat, herein accepted, are hereby established at the top of curb, locating and defining the grade points which shall be connected by true planes or vertical curbs between such adjacent grade points, the elevations of which are therein given, in feet above the City Directrix.

 

Section 4. That the lands heretofore designated and selected by the Board of Park and Recreation Commissioners as evidenced by their Resolution No. 24889 duly adopted on November 16, 1999, for public use for park purposes, to-wit:

 

All that part of the Fractional Southwest Quarter of Section 27, Township 51, Range 33, and the Southeast Quarter of Section 28, Township 51, Range 33, all in the City of Kansas City, Platte County, Missouri, described as follows: Beginning at the northwest corner of the Fractional Southwest Quarter of said Section 27; thence North 89E37'48" East, along the north line of the Fractional Southwest Quarter of said Section 27, a distance of 388.08 feet; thence South 00E22'12" East, a distance of 9.89 feet; South 89E37'48" West, a distance of 149.07 feet; thence South 00E16'51" West, a distance of 257.61 feet; thence South 70E07'18" West, a distance of 237.13 feet; thence North 53E02'17" West, a distance of 167.08 feet; thence South 71E41'48" West, a distance of 313.64 feet; thence South 10E01'02" East, a distance of 431.27 feet to the north line of Line Creek Landing, a subdivision of land in the City of Kansas City, Platte County, Missouri; thence South 67E00'00" along the north line of Lots 16 and 17 of said Line Creek Landing, and their easterly prolongation thereof, a distance of 186.98 feet to the northwest corner of said Lot 16; thence North 00E14'02" West, a distance of 189.95 feet; thence North 89E08'56" West, a distance


of 50.70 feet; thence North 00E31'58" East, a distance of 660.00 feet to the north line of the Southeast Quarter of said Section 28; thence South 89E08'56" East, along the north line of the Southeast Quarter of said Section 28; a distance of 558.97 feet to the point of beginning.

 

Containing 7.6 acres, more or less be and the same is hereby accepted for public use for park purposes and shall remain such forever in accordance with Section 58 of Article III of the Charter of Kansas City.

 

Section 5. That the Council finds that the City Plan Commission has duly endorsed its approval of this Ordinance hereon.
