SECOND COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 040896

 

Approving the preliminary plat of Hidden Oaks, Lots 1 through 66 on an approximately 45.5 acre tract of land generally located at the southwest corner of the intersection of S.E. 97th Street and Woodson. (SD 0345B)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of Hidden Oaks, Lots 1 through 66 on an approximately 45.5 acre tract of land generally located at the southwest corner of the intersection of S.E. 97th Street and Woodson, and more specifically described as follows:

 

The east 45 acres of the South One-Half of the Southeast Quarter of Section 28 and a part of the Northeast Quarter of Section 33, all in Township 48, Range 32, Kansas City, Missouri, more particularly described as follows: Beginning at the southeast corner of the Southeast Quarter of said Section 28; thence North 86E54'34" West, along the south line of said Southeast Quarter Section, a distance of 1320.20 feet, to the southeast corner of the Southwest Quarter of said Southeast Quarter Section; thence South 2E13'01" West, a distance of 205.94 feet, to a point on the northerly right of way line of View High Drive, as now established; thence northwesterly along said northerly right of way line and along a curve to the left, having a radius of 325.00 feet, a central angle of 54E33'51" and whose initial tangent bearing is North 15E54'32" West, an arc distance of 309.51 feet, to a point on the south line of the Southeast Quarter of said Section 28; thence South 86E54'34" East, along the south line of said Southeast Quarter Section, a distance of 45.45 feet, to the southeast corner of Bent Tree, a subdivision of land in Kansas City, Jackson County, Missouri, according to the recorded plat thereof; thence North 2E06'57" East, along the east line of said Bent Tree, a distance of 1325.08 feet (measured) 1324.42 feet (plat), to a point on the north line of the Southwest Quarter of the Southeast Quarter of said Section 28; thence South 86E51'30" East, along the north line of the Southwest Quarter of said Southeast Quarter Section, a distance of 166.75 feet, to the northwest corner of the Southeast Quarter of said Southeast Quarter Section; thence continuing South 86E51'30" East, along the north line of the Southeast Quarter of said Southeast Quarter Section, a distance of 1317.88 feet, to the northeast corner of the Southeast Quarter of said Southeast Quarter Section; thence South 2E06'57" West, along the east line of said Southeast Quarter Section, a distance of 1323.79 feet, to the point of beginning, containing 45.5037 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer shall cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 


2. That the developer submit a macro/micro storm drainage study for the entire development to the City Engineer's Office for approval at the time the first final plat is submitted, and that the developer construct any necessary improvements as required by the City Engineer's Office.

 

3. That the developer obtain the grading consents, and all grading, temporary construction and drainage/sewer easements from the abutting property owner prior to submitting any public improvements.

 

4. That the developer secure permits to construct new or reconstruct existing sidewalks and curb and gutters along the project frontage and along all development street frontages, as required by the Department of Public Works prior to recording of the plat.

 

5. That the developer submit plans for grading, siltation, and erosion control to the City Engineer's Office for approval and permitting prior to beginning any construction activities.

 

6. That the developer secure a Site Disturbance Permit from the Department of Public Works prior to beginning any construction, grading, clearing, or grubbing activities, if the disturbed area exceeds one acre.

 

7. That the developer extend sanitary sewers and/or storm sewers to ensure individual service is provided to all proposed lots and determine adequacy as required by the Department of Public Works.

 

8. That the developer extend water mains as required by the Water Services Department.

 

9. The developer shall construct all new streets and cul-de-sacs, shown on the preliminary plat, to Department of Public Works specifications.

 

10. That the developer submit covenants, conditions and restrictions to the Law Department for approval and enter into a covenant agreement for the maintenance of any stormwater conveyance and detention area tracts.

 

11. That the developer contribute money in lieu of parkland dedication in accordance with the following: 66 single-family dwelling units x 3.7 (persons per unit) x 0.006 (acres per person) x $12,789.30 = $18,738.88.

 

12. That the developer secure approval of the Street Naming Committee for all street names prior to the submittal of the first final plat.

 

13. That the developer secure the approval of the Board of Zoning Adjustment for any proposed subdivision identification signs prior to requesting a sign permit.

 

14. That the developer submit a street tree planting plan as part of the final plat and secure the approval of the City Forester for street trees planted on right of way in front of residential lots, with a copy to be submitted to the Department of City Development. The plan shall include size, type, species and placement of trees.

 

15. That the City Council grant a variance to the 3:1 lot dimension ratio in the Subdivision Regulations for all proposed lots not in conformity with the required ratio.

 

16. That the developer provide adequate sight-distance at the intersection of proposed Sterling Avenue and View High Drive. This improvement must include, but is not limited to, the widening of View High Drive, the construction of a 150-foot tapered northbound turn lane into the proposed subdivision and a 150-foot tapered westbound merge lane, as required by the Department of Public Works, prior to recording the first plat.

 

17. That the developer provide adequate sight-distance at the intersection of proposed Woodson Court and Woodson Avenue/E. 97th Street, and construct the improvements prior to recording the second plat.

 

18. That the developer demonstrate that the capacity of the existing sanitary sewer trunk line located southeast of the subject site is adequate to serve the proposed development, as required by the Public Works Department.

 

19. That the developer obtain an off-site easement for extension of the existing sanitary sewer line located southeast of the subject property, as required by the Public Works Department.

 

20. That the developer demonstrate that the proposed storm water detention facilities satisfy the APWA 5600 Standards prior to submittal of the first final plat.

 

21. That the developer dedicate additional right-of-way for a collector street as required by the Department of Public Works so as to provide a minimum of 30 feet of right of way as measured from the centerline of View High Drive

 

22. That the developer construct or widen Woodson Avenue to a minimum of a 22-feet wide paved section from Bannister Road to proposed Woodson Court as required by the Department of Public Works, prior to recording the second plat.

 

23. That the developer dedicate right of way for the construction of a potential stub street between Woodson Court and the east property line of Phase II, and that the right of way be shown on the development plan, and that the dedication be made prior to recording the second plat as required by the Department of Public Works.

 

24. That the developer extend all storm sewers to the detention tract as required by the Department of Public Works.

 

25. That the developer grant a surface drainage easement or extend the detention tract to include the open channel at the back of Lots 29, 30, 31, 32, 35, 36, 37, 38, 40, 41, 42, and 43, as required by the Department of Public Works.

 

26. That the developer grant a 20 foot wide access easement for the detention tract between Lots 27 and 28 as required by the Department of Public Works.

 

A copy of the preliminary plat is on file in the office of the City Clerk under Document No. 040896, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
