RESOLUTION NO. 041089
Approving an amendment to
the East 23rd Street Area Plan by modifying the Land Use Plan and Map for an
area generally located at the southeast corner of E. 27th Street and Brighton
Avenue to recommend retail commercial uses instead of low density residential
uses.
WHEREAS, on April
22, 1977, the City Council by Resolution No. 47650 adopted the East 23rd Street
Area Plan as a guide for development and redevelopment of that area bounded by
the Kansas City Terminal Railway on the north, Topping Avenue on the east and
Interstate 70 on the south and west; and
WHEREAS, the East
23rd Street Area Plan was amended on March 25, 1983, through the adoption of
Resolution No. 54866 and was further amended on June 1, 2000, through the
adoption of Resolution No. 000633; and
WHEREAS, after
further review by the City Development Department, it has been deemed appropriate
to amend the East 23rd Street Area Plan as it affects that area generally
located at the southeast corner of E. 27th Street and Brighton by modifying the
Proposed Land Use Plan and Map for such area from low density residential (1-8
units/acre) uses to retail commercial uses; and
WHEREAS, public
notice of a hearing before the City Plan Commission was published on June 21,
2004; and
WHEREAS, the City
Plan Commission considered such amendment to the Proposed Land Use Plan and Map
on July 6, 2004; and
WHEREAS, after
all interested persons were given an opportunity to present testimony, the City
Plan Commission did on July 6, 2004, recommend approval of the proposed
amendment to the East 23rd Street Area Plan; NOW, THEREFORE,
BE IT RESOLVED BY
THE COUNCIL OF KANSAS CITY:
Section A. That
the third amendment to the East 23rd Street Area Plan is hereby approved as to
the Proposed Land Use Plan and Map for that area generally located at the
southeast corner of E. 27th Street and Brighton by modifying the recommended
land uses for the area from low density residential (1-8 units/acre) uses to
retail commercial uses. A copy of the amendment to the Land Use Plan and Map
of the East 23rd Street Area Plan is attached hereto as Exhibit A and incorporated
herein by reference.
Section B. That
the amendment to the East 23rd Street Area Plan is consistent and complies with
the FOCUS Kansas City Plan, adopted on October 30, 1997, by Committee
Substitute for Resolution No. 971268, and is adopted as a supplement to the
FOCUS Kansas City Plan.
Section C. That
the Council finds and declares that before taking any action on the proposed
amendment hereinabove, all public notices and hearings required by law have
been given and had.
