COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 951095

 

Approving an amendment to a previously approved preliminary plan in District CP-2 (Local Planned Business Center) on an approximately 8.4 acre tract of land generally located at the southwest corner of Bannister Road and Blue Ridge Boulevard. (5879-CP-16)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved preliminary plan in District CP-2 (Local Planned Business Center) on an approximately 8.4 acre tract of land generally located at the southwest corner of Bannister Road and Blue Ridge Boulevard, and more specifically described as follows:

 

A tract of land in the Northwest 1/4 of the Southeast 1/4 of Section 25, Township 48, Range 33, in Kansas City, Jackson County, Missouri, being more particularly described as follows: Beginning at the point of intersection of the north line of the South 1/2 of the Northeast 1/4 of the Northwest 1/4 of the Southeast 1/4 of said Section with the west right of way line of Blue Ridge Boulevard as now established; said point of beginning also being the easternmost northeast corner of Tract "A"; HEN HOUSE PLACE, a subdivision in Kansas City, Jackson County, Missouri; thence South 1 56'50" East, along said west right of way line, a distance of 330.00 feet; thence North 86 52'12" West, a distance of 609.28 feet; thence North 2 35'46" East, a distance of 605.81 feet to a point on the south right of way line of Bannister Road as now established; thence South 86 46'56" East, along said south right of way line a distance of 577.43 feet; thence South 42 25'35" East, a distance of 35.75 feet to a point on said west right of way line of Blue Ridge Boulevard; thence South 1 56'50" West, along said west right of way line, a distance of 249.99 feet to the point of beginning. Said tract of land containing 366,423 square feet or 8.41 acres more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended,

commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study to the City Engineer's Office for approval and that the developer make any necessary improvements as required by the

City Engineer's Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

4. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources if the disturbed area for the entire development exceeds five

acres.

 

5. That the developer dedicate additional right-of-way as required by the Department of Public Works so as to provide a total of 60 feet of right of way as measured from

the centerline of Bannister Road.

 

6. That the developer construct sidewalks on the west side of Blue Ridge Boulevard and on the south side of Bannister Road in a manner so as not to require removal of any

street trees.

 

7. That the developer extend water mains as required by the Water Department.

 

8. That the developer provide for fire protection as required by the Fire Department.

 

9. That the developer contribute $3,600.00 to the I-435/I-470 Corridor Improvement Fund for off-site transportation improvements.

 

10. That the developer submit a final plan to the City Plan Commission for approval including plans for landscaping and signage. The landscaping plan shall show

adequate area for planting of trees and shrubs within the parking lot and also shall

address reinstallation of previously approved landscaping.

 

A copy of said amendment is on file in the office of the City Clerk under Document No. 951095, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had. _____________________________________________

 

I hereby certify that as required by Chapter 80, Code of Ordinances, the foregoing ordinance was duly advertised and public hearings were held.
