COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 060578

 

Amending a previously approved preliminary plan in District C-3a1-p on a 2.5 acre tract of land generally located along N.E. Vivion Road between I-29 and Old Pike Road. (13538-P)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved preliminary plan in District C-3a1-p (Intermediate Business, Low Buildings - Limited District) on a 2.5 acre tract of land generally located along N.E. Vivion Road between I-29 and Old Pike Road, and more specifically as follows:

 

TRACT I: All of that part of the South One-Half of the Southwest Quarter of the Southwest Quarter of Section 35, Township 51, Range 33, in the City of Gladstone, Clay County, Missouri, lying west of the westerly line of Old Pike Road, as established, except that part conveyed to the State of Missouri for highway purposes by deed filed of record March 20, 1957 as Document No. A79603 and recorded in Book 579 at page 256, except that conveyed to the State of Missouri for highway purposes by deed recorded under Document No. D75899 recorded in Book 1322 at page 306; except that part conveyed to the City of Gladstone for right-of-way for road as set out under Document No. D84300 recorded in Book 1340 at page 913, except that part conveyed to the City of Gladstone under Document No. M1598 in Book 2307 at page 762; also except that part conveyed to the City of Gladstone under Document No. N42635 in Book 2681 at page 570.

 

TRACT II: All that part of the North One-Half of the Northwest Quarter of the Northwest Quarter of Section 2, Township 50, Range 33, in the City of Gladstone, Clay County, Missouri; except that tract conveyed to the State of Missouri for highway purposes by deed filed of record March 20, 1957 as Document No. A79603 and recorded in Book 579 at page 256; except that part conveyed to the State of Missouri for highway purposes by deed of record under Document No. D75899 recorded in Book 1322 at page 306; except that part conveyed to the City of Gladstone for right-of-way for road as set out under Document No. D83400 recorded in Book 1340 at page 913; except that part conveyed to the City of Gladstone under Document No. M1598 in Book 2307 at page 762; also except that part conveyed to the City of Gladstone under Document No. N42635 in Book 2681 at page 570.

 

TRACT III: Lots 2 and 3, H. Kenneth Taylor's Subdivision, an addition in the City of Gladstone, Clay County, Missouri, except that part in roads.


TRACT V: A tract of land part in the Southwest Quarter of Section 35, Township 51, Range 33, Gladstone, Clay County, Missouri, and part in the Northwest Quarter of Section 2, Township 50, Range 33, Kansas City, Clay County, Missouri, more particularly described as follows: Commencing at the northwest corner of said Section 2; thence South 0015' 06" West, along the west line of the Northwest Quarter of said Section 2, a distance of 23.54 feet to a point on the northerly right-of-way line of U.S. Highway Route 69, said point being 312.36 feet left of, and opposite said Highway 69 centerline Station 119+19.88 (Highway plans call Station 119+20.00, 313' lt.), said point also being the point of beginning; thence continuing along said west line, South 0015' 06" West, a distance of 58.94 feet to a point on a curve, 12.00 feet south of, as measured normal to, the centerline of the outer road of said Route 69, as defined in the record plans for said Route 69; thence along a curve to the left, this and the following (4) courses lying 12.00 feet southerly of, as measured normal to, and running parallel with said outer road centerline, having an initial tangent bearing of South 6342' 24" East, a radius of 401.59 feet, an arc distance of 197.71 feet to a point of tangency 12.00 feet right of, and opposite, said outer road centerline pt Station 120+85.03, ; thence North 8805'06" East; a distance of 508.82 feet to a point 12.00 feet right of, and opposite, said outer road centerline pt Station 125+93.85; thence along a curve to the left, having a radius of 1444.39 feet, an arc distance of 214.49 feet to a point 12.00 feet right of, and opposite, said outer road centerline pt Station 128+06.56; said point also being 88.00 feet left of, and opposite said Route 69 centerline Station 128+06.56; thence North 7934'36" East, a distance of 267.44 feet to a point 88.00 feet left of, and opposite said Route 69 centerline Station 130+74.00; thence North 3803'46" East, a distance of 68.11 feet to a point 133.14 feet left of, and opposite said Route 69 centerline Station 131+25.00, said point being on the westerly right-of-way line of Old Pike Road as defined in the record plans for said Route 69; thence North 0525'24" West, along said west right-of-way line, a distance of 28.16 feet to a point 161.20 feet left of, and opposite said Route 69 centerline Station 131+27.45; thence South 7841' 19" West, a distance of 77.46 feet, to a point 160.00 feet left of, and opposite said route 69 centerline Station 130+50.00, this and the following remaining five (5) courses being along the northerly right-of-way line of said Route 69, as now established by right-of-way deeds Document D-75899, recorded in Book 1322, at page 306, and Document A-079603, recorded in Book 579, at page 256; thence South 6816'00" West, a distance of 50.99 feet to a point 150.00 feet left of, and opposite said Route 69 centerline Station 130+00.00; thence South 7934'36" West, a distance of 193.44 feet, to a point 150.00 feet left of, and opposite said Route 69 centerline Station 128+06.56; thence South 8103'26" West, a distance of 206.08 feet to a point 155.30 feet left of, and opposite said Route 69 centerline Station 126+00.53, said point also being 40.00 feet left of, and opposite said outer road centerline Station 125+93.85; thence South 8805'06" West, a distance of 508.82 feet to a point 40.00 feet left of, and opposite said outer road centerline pt Station 120+85.03; thence along a curve to the right, to which the preceding course is tangent, having a radius of 349.59 feet, an arc distance of 198.01 feet to the point of beginning.

 

is hereby approved, subject to the following conditions

 

1.                  That the developer submit a detailed micro storm drainage study as required by Development Services.

 

2.                  That the developer secure permits to construct or reconstruct existing sidewalks, curb and gutter required by Development Services.

 

3.                  That the developer submit a final plan containing a landscaping plan, final grading, location of light poles and fencing.

 

4.                  That no entrance or exit will be provided from Vivion Road.

 

A copy of the preliminary plan is on file in the office of the City Clerk with this ordinance and is made part thereof.

 

Section B. That the Council finds and declares that before any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinances have been given and had.
