ORDINANCE NO. 070451

 

Authorizing the release of an aeronautical easement on and appurtenant to the former Richards-Gebaur Airport.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That various aeronautical easements on and appurtenant to the former Richards-Gebaur Airport in Cass County and Jackson County, Missouri, conveyed to Kansas City, Missouri by the United States of America which appear of record as the instrument numbers and respective books and pages as follows:

 

Tract II (formerly known as Tract #A103) A perpetual non-exclusive and assignable aeronautical property, easement and right-of-way to construct, maintain, repair, operate, patrol, replace, and/or remove a roadway as established by the instrument recorded under Document No. B217344, in Book B7024, at page 388, as assigned to the City of Kansas City, (subject to certain reservations) in the Indenture recorded in Book K1455, at page 1638, in, upon, under, over and across the following: A tract of land situated in the Southeast Quarter of the Southwest Quarter of Section 27, Township 47 North, Range 33 West, Jackson County, Missouri, more particularly described as follows: A strip of land 25 feet in width, lying 12.5 feet on either side of a line described as beginning at a point on the south line of said Southeast Quarter of the Southwest quarter said point being 403.21 feet west of the Southeast corner thereof; thence in a Northeasterly direction, making an angle of 83 degrees 11 minutes 55 seconds with the south line of Southeast Quarter of the Southwest Quarter, 671.88 feet.

 

Title Commitment No. 15 Terms, provisions and conditions relating to the easement (described as Tract II) to be insured as contained in the instrument record in Book B-7024 at Page 389, as Document No. B-217344, as assigned to the City of Kansas City, (subject to certain reservations) in the indenture filed in Book K-1455, at Page 1638, as Document No. K-677151, as supplemented by the documents filed in Book K-1521, at Page 1336, as Document Number K-706523 and in Book K-1523, at Page 1284, as Document No. K-707551, and in Book K-2859, at Page 101, as Document No. K-0027789

 

Title Commitment No. 16 Terms, provisions and conditions relating to the easement (described as Tract II) to be insured as contained in the instrument record in Book B-5306 at Page 528, as Document No. B-342941, as assigned to the City of Kansas City, (subject to certain reservations) in the indenture filed in Book K-1455, at Page 1638, as Document No. K-677151, as supplemented by the documents filed in Book K-1521, at Page 1336, as Document No. K-706523 and in Book K-1523, at Page 1284, as Document No. K-707551, and in Book K-2859, at Page 101 as Document No. K-0027789.

 

Section 2. All recorded in the office of the Recorder of Deeds for Cass County, Missouri, and Jackson County, Missouri, are hereby released to their present owners, their heirs and assigns and the Director of Aviation, if so requested, is authorized to execute a quit claim deed to the present owners, their heirs and assigns, as further evidence thereof.
