Vacating Winchester Avenue lying north of 66th Street and
east of and adjoining Lot 13, "Swope Park Ridge", and all utility
easements over, under, along and across said Street, all in Kansas City, Jackson
County, Missouri. (Case No. 941-V)
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section 1. The Council of Kansas City does hereby
find and declare that on the 6th day of June, 1990, a petition was filed with
the City Clerk of Kansas City by William Chiles, agent for Winchester Ventures
II, for the vacation of Winchester Avenue lying in the Southeast Quarter of
Section 1, Township 48, Range 33 in Kansas City, Jackson County, Missouri,
being more particularly described as follows: Commencing at the Southeast
corner of Lot 13, "SWOPE PARK RIDGE", a subdivision of land in Kansas
City, Jackson County, Missouri; thence North 2 degrees 22 minutes 06 seconds
East, along the East line of said Lot 13 and parallel with the West line of the
Southeast Quarter of the Southeast Quarter of said Section 1, a distance of
18.41 feet to the Point of Beginning of the tract of land herein described;
thence continuing North 2 degrees 22 minutes 06 seconds East, along the East
line of said Lot 13 and parallel with the west line of the Southeast Quarter of
the Southeast Quarter of said Section 1, a distance of 228.15 feet to the
Northeast corner of said Lot 13; thence South 86 degrees 55 minutes 51 seconds
East, along the Easterly prolongation of the North line of said Lot 13, a
distance of 15.35 feet to a point on the Westerly line of "Winchester
Office Center", a subdivision of land in Kansas City, Jackson County,
Missouri; said point also being 14.65 feet West of the West line of the
Southeast Quarter of the Southeast Quarter of said Section 1, as measured along
said Easterly prolongation; thence Southerly along a curve to the left, having
an initial tangent bearing of South 10 degrees 04 minutes 29 seconds West, a
radius of 1,700.00 feet, and a central angle of 7 degrees 42 minutes 23
seconds, an arc length of 228.65 feet to the Point of Beginning, giving the
distinct description on the street to be vacated, and also the names of the
persons and corporations owning or claiming to own the property fronting
thereon, and that due notice of the pendency of said petition has been given
for twenty (20) days in the newspaper doing the city printing, and that the
consent of the persons and corporations owning or claiming to own three-fourths
of the front feet of the property immediately adjoining said street has been
obtained in writing, that said consent has been acknowledged as deeds are
acknowledged, and was duly filed with the petition for such vacation in the
City Clerk's Office.
Section 2. That the Council finds that the City
Plan Commission has duly endorsed its approval of this Ordinance hereon.
Section 3. That Winchester Avenue lying in the
Southeast Quarter of Section 1, Township 48, Range 33 in Kansas City, Jackson
County, Missouri, being more particularly described as follows: Commencing at
the Southeast corner of Lot 13, "SWOPE PARK RIDGE", a subdivision of
land in Kansas City, Jackson County, Missouri; thence North 2 degrees 22
minutes 06 seconds East, along the East line of said Lot 13 and parallel with
the West line of the Southeast Quarter of the Southeast Quarter of said Section
1, a distance of 18.41 feet to the Point of Beginning of the tract of land
herein described; thence continuing North 2 degrees 22 minutes 06 seconds East,
along the East line of said Lot 13 and parallel with the west line of the

line of the Southeast Quarter of the Southeast Quarter of said Section 1, as

the left, having an initial tangent bearing of South 10 degrees 04 minutes 29
seconds West, a radius of 1,700.00 feet, and a central angle of 7 degrees 42
minutes 23 seconds, an arc length of 228.65 feet to the Point of Beginning, be
and the same is hereby vacated.
Section 4. That the City Clerk of Kansas City,
Missouri, be and she is hereby authorized and directed to acknowledge this
ordinance as deeds are acknowledged, and to cause this ordinance and the
consent of property owners hereinbefore referred to, to be filed for record in
the Recorder's Office in Jackson County, Missouri.
Section 5. All Ordinance or parts of Ordinances in
conflict with this Ordinance are, in so much as they conflict with this
Ordinance, hereby repealed.
