COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 970712

 

Approving a Community Unit Project on approximately a 3.04 acre tract of land generally located on the south side N.E. Parvin Road at N. Hardesty Avenue. (11974-CUP-1)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a Community Unit Project on approximately a 3.04 acre tract of land generally located on the south side of N.E. Parvin Road at N. Hardesty Avenue, and more specifically described as follows:

 

A tract of land in the Southeast Quarter of Section 5, Township 50, Range 32, Kansas City, Clay County, Missouri, being described as follows: Commencing at the southwest corner of said Southeast Quarter; thence South 89 27'18" East, along the south line of said Southeast Quarter, 1128.60 feet to the true point of beginning of the tract to be herein described; thence North 4 07'18" West (Deed-North 4 40'00" West), 231.30 feet (Deed-231.92 feet) to a point on the southerly right of way line of N.E. Parvin Road, as now established; thence northeasterly, along said southerly right of way line, on a curve to the left, having an initial tangent bearing of North 88 56'06" East (Deed-North 88 58'45" East), a radius of 1195.92 feet, an arc distance of 374.35 feet, (Deed-375.28 feet); thence North 71 00'00" East, along said southerly right of way line, 133.66 feet (Deed-137.86 feet); thence South 0 10'05" East (Deed-South 0 42'47" West), 343.72 feet (Deed-376.09 feet) to a point on the south line of said Southeast Quarter; thence North 89 27'18" West, along said south line, 477.91 feet (Deed-483.70 feet) to the true point of beginning. Containing 3.04 acres, more or less. Except that part south being used for road right of way.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended,

commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineer's Office for approval and that the developer make any improvements

as required by the City Engineer's Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

4. That the developer dedicate additional right of way for N.E. Russell Road as required by the Department of Public Works so as to provide a total of 25 feet of right of way

as measured from the centerline of N.E. Russell Road.

 

5. That the developer enter into a Cooperative Agreement with the City whereby the developer agrees to contribute $12,365.00 for the construction of sidewalks, curb,

gutter and streetlights for N.E. Russell Road as required by the Department of Public

Works.

 

6. That the developer improve N.E. Parvin Road to primary arterial street standards by installation of streetlights and sidewalks as required by the Department of Public

Works.

 

7. That the developer include a statement on the final plat prohibiting direct vehicular access from Lots 1 and 5 onto N.E. Parvin Road and from Lots 3 and 4 onto N.E.

Russell Road.

 

8. That the developer submit a certificate of survey to the City for approval prior to the sale of individual units.

 

9. That the developer extend water mains as required by the Water Services Department.

 

10. That the developer extend sanitary sewers as required by the Department of Public Works.

 

11. That the developer construct all-weather roads and provide for fire protection prior to construction beyond footings and foundations.

 

12. That the developer submit covenants, conditions and restrictions to the Law Department for approval.

 

13. That the developer contribute $2,317.63 in lieu of parkland dedication for 18 multi-family units in satisfaction of Section 66-128 of the Subdivision Regulations.

 

14. That the developer submit a street tree planting plan as part of the final plat and secure the approval of the City Forester for street trees planted on right of way in

front of residential lots. The plan shall include size, type, species and placement of

trees and a copy shall be submitted to the Department of City Development.

 

15. That the developer submit a final plan to the City Plan Commission for approval including plans for landscaping consisting of berms, trees and plantings.

 

A copy of said Community Unit Project plan is on file in the office of the City Clerk under Document No. 970712, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
