ORDINANCE NO. 100429

 

Authorizing the City Manager to execute a multi-party Memorandum of Understanding with the U.S. Department of Transportation, Federal Transit Administration, for purposes of establishing a framework for the projects funded by the Green Impact Zone’s TIGER grant; and recognizing an emergency.

 

WHEREAS, the Kansas City region’s TIGER grant application was awarded $50 Million by the U.S. Department of Transportation; and

 

WHEREAS, part of that grant includes $26.5 Million in the Green Impact Zone for transit access improvements; and

 

WHEREAS, as a condition of the TIGER grant process, the Federal Transit Administration (“FTA”) requires that the City execute a Memorandum of Understanding for purposes of concisely outlining the nature of the project, its projected budget, and projected timeline to completion; and

 

WHEREAS, this Memorandum of Understanding will provide the framework for the official grant award to follow and will enable the project’s sponsor to incur eligible project expenses; and

 

WHEREAS, this Memorandum of Understanding additionally serves as evidence of the City’s intent to meet the schedule and abide by the scope and budget established for the Green Impact Zone; and

 

WHEREAS, the work within the Green Impact Zone to be funded by this grant relates to public improvements to be paid by federal funds and to contracts relating to the design, repair, maintenance or construction of such public improvements; and

 

WHEREAS, time is of the essence as the FTA requires this Memorandum of Understanding be executed by the project partners no later than Monday, May 17, 2010; NOW, THEREFORE;

 

  BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the City Manager is hereby authorized to execute the multi-party Memorandum of Understanding, a copy of which is on file with the Director of Public Works and is hereby approved in substantial form.

 

Section 2. That this ordinance recognizes an emergency as provided in Section 503(a)(3)(D) of the Charter.
