ORDINANCE NO. 060758

Authorizing the Director of City Development to execute a contract for $180,000.00 with Highland Associates, L.P. to construct eight (8) affordable single family rental homes in the Southwest Ivanhoe Neighborhood.

WHEREAS, the 2004 Consolidated Housing and Community Development Plan, and Committee Substitute For Resolution No. 040032 were approved by City Council on February 26, 2004; and

WHEREAS, in the 2004 Consolidated Plan, the City Council approved a funding appropriation of $380,000.00 to assist in the financing of affordable multi-family developments in the Ivanhoe Neighborhood with HOME Investment Partnership Act funds; and

WHEREAS, City Council approved $200,000.00 of 2004 HOME Investment Partnership Act funds for an Ivanhoe Neighborhood affordable multi-family project called the 42nd and Highland Housing Development (a/k/a Woodland Heights III) by passage of Ordinance No. 050784 on August 4, 2005; and

WHEREAS, the remaining $180,000.00 of the 2004 HOME Investment Partnership Act funds for Ivanhoe Neighborhood affordable multi-family developments has been allocated to the Woodland Heights IV Project (Project) located at the southeast side of Highland at 42nd Street and the southeast and southwest sides of Woodland at 41st Street, Kansas City, Missouri; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the Director of City Development, on behalf of the City of Kansas City, Missouri, is hereby authorized to enter into a $180,000.00 contract with Highland Associates, L.P. A copy of the contract, in substantial form, is available in the office of the Director of City Development and is incorporated herein by reference.

Section 2. That $180,000.00 is hereby appropriated from the Unappropriated Fund Balance of the 2005 HOME Fund No. 2940 to the following account:

07-2940-645301-B HOME Fund $180,000.00

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
