ORDINANCE NO. 130961

 

 

Amending Sections 88-530 of the Zoning and Development Code regarding site plan review and approvals to eliminate city plan commission review of site plans connected to building permit applications.

 

WHEREAS, Chapter 88, the Zoning and Development Code, provides for site plan review for building projects not requiring more extensive development plan review; and

 

WHEREAS, the site plan review provided for in Section 88-530 is done in connection with a building permit application; and

 

WHEREAS, city plan commission review on building permit applications brings uncertainty and delay into what should be a clear administrative process; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 88, Zoning and Development Code, is hereby amended by repealing Sections 88-530-08 and 88-530-10 and replacing said sections with new sections of like number and subject matter, said sections to read as follows:

 

88-530-08 Review and Action

 

A building permit application constitutes site plan review application. The planning and development director must review each complete application for site plan approval and take one of the following actions:

 

1. approve the application;

 

2. identify those revisions or modifications that would allow approval of the application;

 

3. approve the application with conditions; or

 

4. disapprove the application.

 

88-530-10 Appeals of Site Plan Decisions

 

Appeals of the city planning and development director's decision on a site plan application may be taken to the board of zoning adjustment by filing a notice of appeal with the city planning and development director. Appeals must be filed within 15 calendar days of the date of the city planning and development director's decision.
