COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 050751

 

Rezoning an area of approximately .47 acres generally located on the west side of N. Oak Trafficway about 2,000 feet north of N.E. Barry Road from District R-4-O to District PD/R-4-O and approving a development plan for the same.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0637, rezoning an area of approximately .47 acres generally located on the west side of N. Oak Trafficway about 2,000 feet north of N.E. Barry Road from District R-4-O (Low Apartments, Administrative Office Buildings) to District PD/R-4-O (Planned District/Low Apartments, Administrative Office Buildings), said section to read as follows:

 

Section 80-11A0637. That an area legally described as:

 

Tract C, as shown on certificate of survey of part of lot 3 as filed in Document No. F-28325, Book 1662, Page 467, On March 6, 1986, Gashland Heights Resurvey a subdivision in the City of Kansas City, Clay County, Missouri.

 

is hereby rezoned from District R-4-O (Low Apartments, Administrative Office Buildings) to District PD/R-4-O (Planned District/Low Apartments, Administrative Office Buildings), all as shown outlined on a map marked Section 80-11A0637, which is attached hereto and made a part hereof, and which is hereby adopted as part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer dedicate additional right of way for a primary arterial with a bicycle lane as required so as to provide a minimum of 56 feet of right of way as measured from the centerline of N Oak Trafficway.

 

2. That the developer secure permits to reconstruct existing sidewalks and curb and gutter as necessary along the development street frontage as required prior to the issuance of a certificate of occupancy.

 

3. That the developer secure the approval of the Board of Zoning Adjustment for any necessary variances.

 

4. That the developer submit a final plan to the City Plan Commission for approval, including detailed information on landscaping, signage (including elevations), new lighting (including a photometric study showing zero foot-candles at the plan boundary and no direct illumination beyond the property line) and building elevations.

 

A copy of said development plan is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices have been given and hearings have been held as required by the Zoning Ordinance.
