ORDINANCE NO. 990106
Approving an amendment to a previously approved
preliminary plan in District CP-2 (Local Planned Business Center) on
approximately a 36 acre tract of land generally located at the northwest corner
of N.E. 50th Terrace and N. Oak Trafficway. (6331-CP-8)
BE IT ORDAINED BY THE COUNCIL OF
KANSAS CITY:
Section A. That an amendment to a
previously approved preliminary plan in District CP-2 (Local Planned Business
Center) on approximately a 36 acre tract of land generally located at the
northwest corner of N.E. 50th Terrace and N. Oak Trafficway, and more
specifically described as follows:
All of North Oak
Business Park and all of North Oak Business Park, 2nd Plat, subdivisions in
Kansas City, Clay County, Missouri, and all that part of the Southwest Quarter
of Section 35, Township 51, Range 33, in Kansas City, Clay County, Missouri,
more particularly described as follows: Commencing at the southeast corner of
said Southwest Quarter; thence North 033'19" East along the east line of
said Southwest Quarter, 1,839.83 feet; thence North 8926'55" West, 50
feet to the northeast corner of North Oak Business Park, a subdivision in said
city, county and state according to the recorded plat thereof and the point of
beginning of the tract of land to be herein described; thence North
033'19" East parallel with the east line of said Quarter Section, 670.04
feet; thence North 8926'55" West, parallel with the north line of said
Southwest Quarter, 191 feet; thence North 033'19" East, parallel with the
east line of said Southwest Quarter, 120 feet to a point on the north line of
said Southwest Quarter; thence North 8926'55" West along the north line
of said Southwest Quarter, 507.78 feet to the northeast corner of Tract 1,
North Oak Business Park, 2nd Plat, a subdivision in said city, county, and
state, according to the recorded plat thereof; thence generally south and east
along the north and east boundary of said North Oak Business Park, 2nd Plat,
the following courses and distances; thence South 033'05" West, 341.54
feet; thence South 8926'55" East, 20 feet; thence South 033'05"
West, 42 feet; thence South 8926'55" East, 201.82 feet; thence South
033'05" West, 28.50 feet; thence South 8926'55" East, 281.93 feet;
thence South 033'19" West, 102.96 feet to a point of curvature; thence
southerly and southwesterly along a curve to the right, having a radius of 550
feet, and a central angle of 1526'36", a distance of 148.25 feet; thence
South 1559'55" West, tangent to the last described curve, 61.25 feet to a
point of curvature; thence southerly along a curve to the left, tangent to the
last described course, having a radius of 300 feet, and a central angle of
1328'09", a distance of 70.53 feet to a point on the north line of said North
Oak Business Park, being also the southeast corner of Lot 1 of said, North Oak
Business Park, 2nd Plat; thence South 8926'55" East along the northerly
line of said North Oak Business Park, 241.82 feet to the point of beginning.
Containing 337,148 square feet, more or less.
is hereby approved, subject to the following
conditions:
1. That
the developer improve N.E. 50th Terrace to collector street standards as required
by the Department of Public Works at the time of development of any building
making an aggregate total of 155,000 square feet or greater within the plan
area.
2. That
the developer extend water main as required by the Water Services Department.
3. That
the developer provide for fire protection as required by the Fire Department
prior to construction beyond foundations.
4. That
the developer install landscaping per the 1983 Stipulation Agreement along the
north property line from the west line of the fire station property to the
southeast corner of the preliminary plat of Creekwood Extension.
5. That
the developer submit a final plan for each phase to the City Plan Commission
for approval, including plans for landscaping, grading, signage (including
elevations) and building elevations. The final plan for the communications
tower must include a solid wood fence around the communications tower and any
equipment which is installed to support the tower.
A copy of said amendment is on file in the
office of the City Clerk under Document No. 990106, which is attached hereto
and made a part hereof.
Section B. That the Council finds
and declares that before taking any action on the proposed amendment
hereinabove, all public notices and hearings required by the Zoning Ordinance
have been given and had.
