ORDINANCE NO. 971636, AS AMENDED

 

Approving an amendment to the South 31st Street Urban Renewal Plan by expanding the boundaries to include an area generally located on both sides of platted Holly Street, between extended 33rd Street and extended 36th Street; and declaring the additional areas to be a blighted and insanitary area in need of redevelopment and rehabilitation pursuant to the Missouri Land Clearance for Redevelopment Authority Law subject to certain findings and conditions.

 

WHEREAS, Section 99.430, Revised Statutes of Missouri, provides that a legislative body may approve a declaration of blight and approve an urban renewal plan for the same area simultaneously; and

 

WHEREAS, the City Council has previously declared the area generally bounded by 31st Street on the north, Madison Avenue on the east, except between 32nd Street and 36th Street, where the area jogs over to Holly Street, 36th Street on the south, and the Burlington Northern Rail Line on the west, except between 33rd Street and 36th Street, where the Urban Renewal Area jogs over to a line halfway between Holly Street and Terrace Street, a blighted and insanitary area by Ordinance No. 58726, passed December 12, 1985; and

 

WHEREAS, it is desirable and in the public interest that the South 31st Street Urban Renewal Plan be expanded to include additional area generally located on both sides of platted Holly Street, between extended 33rd Street and extended 36th Street; and

 

WHEREAS, said expanded area is a blighted/insanitary area as defined by Section 99.320, RSMo, so as to constitute an economic or social liability to the public health, safety, morals, or welfare; and

 

WHEREAS, the Land Clearance for Redevelopment Authority of Kansas City, Missouri, did on July 25, 1997, adopt a resolution recommending the expansion of the Urban Renewal Area to include the additional area, said resolution being set forth and incorporated in the proposed Urban Renewal Plan Amendment; and

 

WHEREAS, the City Plan Commission has reviewed the amendment to the South 31st Street Urban Renewal Plan to expand the area on November 4, 1997, said recommendation of the City Plan Commission being set forth on Exhibit A attached hereto and incorporated herein by reference; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to the proposed Urban Renewal Area, identified as the South 31st Street Urban Renewal Area, is hereby approved to expand the area to include tracts generally located on both sides of platted Holly Street, between extended 33rd Street and extended 36th Street, as delineated on the Modification to the Urban Renewal Plan for the South 31st Street Urban Renewal Plan, more specifically described as follows:

 


TRACT TWO: Lots 21 to 39, both inclusive, and that part of the reserved tract lying north of and adjoining Lots 30 and 31, and adjoining the north end of Holly Street, Swensons Industrial Addition, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof; except that part of said reserved strip lying north of and adjoining the east 25 feet of Lot 31, and except that part of Lots 31 and 32 described as follows: Beginning at the northeast corner of Lot 31; thence west along the north line thereof, 25 feet; thence southeasterly to a point on the east line of Lot 32 which is 137 feet south of the northeast corner of Lot 31; thence north, 137 feet to the point of beginning.

 

TRACT THREE: All that part of the Southwest 1/4 of Section 18, Township 49, Range 33, in Kansas City, Jackson County, Missouri, described as follows: Beginning at the southeast corner of said 1/4 Section; thence west along the south line of said 1/4 Section, 231.32 feet; thence North 5922' West, 14.35 feet; thence on a curve to the right having a radius of 412.756 feet, a distance of 89.21 feet to the east line of right of way of the St. Louis & San Francisco Railroad, said point being 68.38 feet northerly of the south line of said 1/4 Section, measured along the east line of said Railroad right of way; thence northerly along said easterly line of said right of way to a point 100 feet due north of south line of said 1/4 Section; thence east and parallel to said south line 341.00 feet to the east line of said 1/4 Section; thence south 100 feet to the beginning.

 

TRACT FOUR: All that part of the Northwest One-Quarter of Section 19, Township 49, Range 33, in Kansas City, Jackson County, Missouri, described as follows: Beginning at the northeast corner of said Quarter Section; thence south along the east line of said Quarter Section, 100.00 feet; thence northwesterly to a point on the north line of said Quarter Section, 100.00 feet west of the point of beginning; thence east along the north line of said Quarter Section, 100.00 feet to the point of beginning.

 

and such area is hereby declared to be a blighted area and in need of redevelopment and rehabilitation and is appropriate for an Urban Renewal Project and that the undertaking by the Land Clearance for Redevelopment Authority of Kansas City, Missouri, of surveys and plans for an urban renewal project of the character contemplated by Section 99.430, Revised Statutes of Missouri, as amended, and the proposed Urban Renewal Area is hereby approved.

 

Section B. That the Council has duly made the findings necessary for compliance with Sections 99.320 and 99.430, Revised Statutes of Missouri, as amended.

 

Section C. That the Urban Renewal Plan for the South 31st Street Urban Renewal Area, a copy of which is on file in the office of the City Clerk under Document No. 971636, and which is incorporated herein by reference, titled Modification to Urban Renewal Plan for the South 31st Street Urban Renewal Area, is hereby approved.

 

Section D. That said Urban Renewal Plan and amendments are hereby found to be feasible and in conformance with the Master Plan for the development of the community as a whole.

 

Section E. This ordinance shall become effective upon the happening of all of the following: (a) ten days have passed since the ordinance has been passed by the Council; (b) certification to the City Clerk by the Director of the Department of City Development that a neighborhood improvement district (pursuant to Sections 67.453 through 67.475, RSMo) (NID) or a community improvement district (pursuant to Section 67.1400 through 67.1560, RSMo) (CID) has been created and empowered to collect and expend assessments of $100,000.00 for the costs of acquisition of Tracts 2, 3 and 4, and costs of creating the NID/CID; and (c) certification to the City Clerk by the Director of the Department of City Development that a contract by the City has been executed with LCRA for payment of up to $300,000.00 for the costs of acquisition of Tracts 2, 3 and 4, and costs of creating the NID/CID.
