SECOND COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 070339

 

Approving an amendment to a previously approved development plan in District CP-2 on approximately 10.86 acres generally located on the east side of N. Oak Trafficway, north of N.E. 107th Street and south of future Shoal Creek Parkway. (11924-CP-8)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved preliminary plan in District CP-2 (Local Planned Business Center) on approximately 10.86 acres generally located on the east side of N. Oak Trafficway, north of N.E. 107th Street and south of future Shoal Creek Parkway and more specifically described as follows:

 

All that part of the Southeast Quarter of Section 26, Township 52, Range 33, Kansas City, Clay County, Missouri being described as follows: Commencing at the Northwest corner of said Southeast Quarter; thence South 89 degrees 30 minutes 57 seconds East, along the North line of said Southeast Quarter, a distance of 76.38 feet to a point on the Easterly Right-of-Way line of North Oak Trafficway, also being the Point of Beginning of the tract of land herein to be described; thence continuing along the North line of said Southeast Quarter, South 89 degrees 30 minutes 57 seconds East, a distance of 633.62 feet to the Northwest corner of MULLINS CORNER, a subdivision of land in Kansas City, Clay County, Missouri; thence (along the Westerly line of said MULLINS CORNER the following 7 courses) South 00 degrees 32 minutes 17 seconds West, a distance of 235.49 feet; thence South 09 degrees 15 minutes 19 seconds West, a distance of 170.13 feet; thence South 27 degrees 16 minutes 46 seconds West, a distance of 144.44 feet; thence South 00 degrees 32 minutes 17 seconds West, a distance of 143.16 feet to the Northerly Right-of-Way line of Northeast 107th Street; thence (along the Northerly Right-of-Way line of said Northeast 107th Street the following 6 courses) Southeasterly along a curve to the left, having an initial tangent bearing of South 35 degrees 05 minutes 18 seconds West, a radius of 225.00 feet, an arc length of 47.39 feet; thence along a reverse curve, having a radius of 175.00 feet, an arc length of 206.22 feet; thence North 89 degrees 27 minutes 43 seconds West, a distance of 71.54 feet; thence along the Northwesterly line of said MULLINS CORNER, and the Northerly Line of TOWNHOMES AT MULLINS CORNER, along a curve to the right, being tangent to the last described course, having a radius of 175.00 feet, an arc length of 132.64 feet; thence (along the Northerly line of said TOWNHOMES AT MULLINS CORNER the following 2 courses) along a reverse curve, having a radius of 230.00 feet, an arc length of 171.75 feet; thence along a reverse curve, having a radius of 38.00 feet, an arc length of 31.05 feet to the Easterly Right-of-Way line of said North Oak Trafficway; thence North 00 degrees 32 minutes 17 seconds East, along the Easterly Right-of-Way line of said North Oak Trafficway, a distance of 685.28 feet; thence continuing along the Easterly Right-of-Way line of said North Oak Trafficway, Northeasterly along a curve to the Right, being tangent to the last described course, having a radius of 16.40 feet, an arc length of 25.75 feet to the Point of Beginning. Said tract contains 10.86 Acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2. That the developer submit a macro/micro storm drainage study to Development Services, City Development Department for approval for the entire development when the first plat is submitted, and that the developer construct any improvements as required by Development Services, City Development Department.

 

3. That the developer dedicate additional right of way for a primary arterial with a bike lane as required by Development Services so as to provide a minimum of 56 feet of right of way as measured from the centerline of N. Oak Trafficway.

 

4. That the developer subordinate to the City all private interest in the area of any right-of-way dedication as required by Development Services, and that the developer be responsible for all costs associated with subordination activities.

 

5. That the developer submit plans for grading, siltation, and erosion control to Development Services for approval and permitting prior to beginning any construction activities.

 

6. That the developer secure a land disturbance permit from Development Services prior to beginning any construction, grading, clearing, or grubbing activities, if the disturbed area exceeds one acre.

 

7. That the developer extend water mains as required by the Water Services Department.

 

8. That the developer extend sanitary sewers to ensure individual service is provided to all proposed lots and determine adequacy as required by Development Services.


9. That the developer provide a storm water conveyance system to serve all proposed lots within the development and determine adequacy as required by Development Services.

 

10. That the developer submit covenants, conditions and restrictions to the Law Department for approval for the maintenance of private open space and enter into a covenant agreement for the maintenance of any stormwater detention area tracts.

 

11. That the developer secure permits to construct or reconstruct existing sidewalks, cubs, gutter, storm sewers, and streetlights as necessary along all development street frontages, or submit a letter from a Missouri licensed civil engineer stating that the sidewalks, curb and gutter are in a good state of repair and meet the requirements set forth in Chapters 56 and 64, Code of Ordinances, as required by Development Services, prior to recording the plat.

 

12. That the developer dedicate additional right of way for N.E. Shoal Creek Parkway to provide a total of 100 feet of right of way as measured from the centerline of N.E. Shoal Creek Parkway as required by the Board of Parks and Recreation Commissioners.

 

13. That the developer provide for fire protection as required by the Fire Department.

 

14. That the developer submit a final plan to the City Plan Commission for approval, including plans for grading, landscaping, screening, berming, lighting (provide a photometric study, with the intent that there shall be no direct illumination beyond the property line), signage, building elevation drawings and pedestrian connections from the street to the buildings within the development.

 

15. That the developer enter into a Cooperative Agreement with the City at such time as a final plat is approved for Lot 4 as shown on the preliminary plan whereby the developer agrees to contribute 25% of the cost for the installation of a traffic signal at the intersection of N. Oak Trafficway and N.E. 108th Street.

 

16. That the developer construct a northbound right turn lane of at least 50 feet of storage with appropriate tapers along N. Oak Trafficway at the driveway into the development located north of N.E. 107th Street.

 

17. That the developer improve the south half of Shoal Creek Parkway from N. Oak Trafficway to the first drive entrance east of N. Oak Trafficway at the time of the development of Lot 3 as shown on the preliminary plan as required by the Board of Parks and Recreation Commissioners.

 

18. That the developer improve the south half of Shoal Creek Parkway from the first drive entrance east of N. Oak Trafficway to the eastern boundary of the development as shown on the preliminary plan at the time of the development of Lot 4 as required by the Board of Parks and Recreation Commissioners.

 

A copy of said amendment is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
