ORDINANCE NO. 140025

 

Authorizing the City Manager to execute two memorandums of understanding amongst the City of Kansas City, Missouri, the Natural Resources Defense Council and the Institute for Market Transformation for the purpose of determining the scope of participation in the City Energy Project.

 

WHEREAS, the City Energy Project (the “Project”) is a three-year project sponsored by Natural Resources Defense Council (“NRDC”) and Institute for Market Transformation (“IMT”) that is designed to work with 10 cities to adopt and implement policies and programs to increase energy efficiency in large commercial and institutional buildings; and

 

WHEREAS, on August 22, 2013, the City Council unanimously adopted Resolution No. 130616, authorizing the City Manager to submit a proposal (the “Proposal”) to NRDC and IMT to participate in the City Energy Project; and

WHEREAS, on August 30, 2013, the City of Kansas City, Missouri (the “City”) submitted a proposal to participate in the City Energy Project; and

 

WHEREAS, NRDC and IMT have selected the City to participate in the Project; and

 

WHEREAS, by participating in the Project, the City will receive technical assistance from NRDC and IMT, as well as input and feedback from the other nine cities adopting and implementing policies and programs as a part of the Project; and

 

WHEREAS, a primary focus of the Project will be benchmarking energy use in large commercial and institutional buildings, together with transparency of energy usage; and

 

WHEREAS, the City is currently benchmarking energy use in its own buildings and wishes to disclose its energy usage in order to encourage other building owners to do likewise; and

 

WHEREAS, several owners and managers of large commercial and institutional buildings in Kansas City are actively benchmarking their energy use, are supportive of the Project, will disclose their energy usage, will share information regarding their efforts to improve the energy efficiency of their buildings, and will promote energy efficiency improvements by other large building owners; and

 

WHEREAS, the Project provides an opportunity for the City to work collaboratively with the Greater Kansas City Chamber of Commerce, the Kansas City Industrial Council, Kansas City Power and Light Company, and building owners in the City in a manner similar to that used to develop the City’s Climate Protection Plan (the “Plan”) and recent upgrades to the City’s energy codes for newly-constructed and renovated buildings; and

 

WHEREAS, improving the energy efficiency of large commercial and institutional buildings will help the City achieve community-wide greenhouse gas (“GHG”) reduction goals in the Plan while simultaneously helping building owners reduce energy use and utility costs; and

 

WHEREAS, participation in the Project will further reinforce the City’s position as a national leader among municipalities who are promoting energy efficiency, energy conservation, and GHG reductions; and

 

WHEREAS, execution of the two memorandums of understanding are necessary to govern the scope of participation of the parties during Project implementation; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the City Manager is authorized to execute two memorandums of understanding amongst the City, NRDC and IMT for the purpose of determining the scope of participation in the City Energy Project. The two memorandums of understanding are approved in substantial form and are on file in the office of the City Manager.
