ORDINANCE NO. 090708

 

Authorizing the Director of Aviation to enter into a contract with Engineered Arresting Systems Corporation (ESCO) for the purchase of Engineered Materials Arresting System (EMAS), Project No. 62090340, authorizing the expenditure of previously appropriated funds not to exceed $8,500,000; and recognizing an emergency

 

WHEREAS, the Aviation Department will be accepting bids for construction Project No. 62090340 - Improve Runway 1-19 Safety Area Construction at Charles B. Wheeler Downtown Airport on August 11, 2009 for installation of an EMAS system; and

 

WHEREAS, without using an EMAS system at the Downtown Airport, there would be a loss of roughly 2000 feet of runway length in order to have the FAA mandated 1000 foot long safety areas beyond each end of RW 1-19; and

 

WHEREAS, the City desires to purchase low-strength concrete blocks for use in Project No. 62090340; and

 

WHEREAS, ESCO is the sole supplier approved by the FAA for the design and manufacture of low-strength concrete blocks engineered to progressively slow an errant aircraft by dissipating energy from the landing gear into crushing of the EMAS blocks; and

 

WHEREAS, the purchase of any or all of these blocks is contingent on an offer and acceptance of an FAA grant; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Director of Aviation is hereby authorized to execute, on behalf of the City, a contract with Engineered Arresting Systems Corporation for the purchase of Engineered Materials Arresting System. A copy of the contract is on file in the Aviation Department.

 

Section 2. That the Director of Aviation is authorized to expend the sum not to exceed $8,500,000.00 from funds previously appropriated to Account No. 10-8300-627270-B.

 

Section 3. That this ordinance is recognized as an emergency measure within the provisions of Section 503 of the City Charter in that it relates to the construction of a public improvement and will be paid wholly or in part by federal funds, and shall take effect in accordance with that section.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
