ORDINANCE NO. 050818

 

Authorizing the Director of Public Works to execute an Intergovernmental Agreement with the M150 & 135th Street Transportation Development District and a Termination and Release Agreement regarding a Cooperative Agreement regarding the State Line Station Unit 2 Development.

 

WHEREAS, the District is a Transportation Development District formed pursuant to the Transportation Development District Act, Sections 238.200 238.275 R.S.Mo., as amended; and

 

WHEREAS, the City of Kansas City, Missouri, a constitutional charter city and municipal corporation of the State of Missouri (the City) is authorized to enter into agreements for its municipal purposes; and

 

WHEREAS, the State Line Station Unit 2 Development (the Development) is a new urban retail project generally bounded by 135th Street on the north, Missouri Highway 150 on the west;

 

WHEREAS, one of the conditions of approval of the Development is that the Developer enter into a Cooperative Agreement for Partial Funding of Storm Water Improvements with the City for partial funding of the Improvement to mitigate potential storm water concerns specifically and uniquely attributable to construction of the Development

 

WHEREAS, the District believes that it is in the best interest of the District and that it will protect the general health, safety, morals, and welfare of the citizens of Kansas City, Missouri and the owners of property lying within the boundaries of the District for the District to assist the City in making improvements to Transportation Projects which will mitigate potential storm water concerns downstream from the District; and

 

WHEREAS, the City and the District wish for this Agreement to supplant and replace in full the Cooperative Agreement in that it is more appropriate for the City and the District to take on the obligation to reconstruct the intersection of 137th Street and Wyandotte; and

 

WHEREAS, the City has agreed to terminate the Cooperative Agreement and any of the Developers obligations under the Cooperative Agreement; and

 

WHEREAS, the City intends to take on all design and construction obligations relative to the Improvement or other Downstream Transportation Projects; NOW, THEREFORE,

 


BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Director of Public Works is authorized to execute an Intergovernmental Agreement between the M150 & 135th Transportation Development District and the City of Kansas City, Missouri.

 

Section 2. That the Director of Public Works is authorized to execute a Termination and Release Agreement regarding a Cooperative Agreement for funding of public improvements between the City of Kansas City, Missouri and State Line Shops, LLC.
