ORDINANCE NO. 070422

 

Accepting a warning siren easement from BPI Midwest, LLC, under which the City desires to construct, maintain, and repair a warning siren located in Kansas City, Clay County, Missouri; and authorizing the City Clerk to record this ordinance and attached easement.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That said warning siren easement in Kansas City, Clay County, executed by said BPI Midwest, LLC is described as follows:

All that part of the E1/2 of the NW1/4, Section 36, Township 52, Range 32 in Amber Meadows Sixth Plat, Tr B, a subdivision of land in Kansas City, Clay County, Missouri.

Section 2. The warning siren easement shall be used by Kansas City as the permanent location of warning siren improvements to be constructed therein including any necessary appurtenances to it; and Kansas City shall have the right to enter in or authorize the entry in and upon such easements for the purpose of constructing, reconstructing, maintaining, operating and repairing said improvements or making connections thereto.

Section 3. There shall be reserved to the owners of the land in which such permanent easements are taken the right to use the land in any way which will not interfere with the proper, safe and continuous use of the facilities to be constructed in and upon such easements.


Section 4. That said warning siren easement which is attached hereto and incorporated herein by reference, is hereby accepted. That upon the effective date of this Ordinance, the City Clerk is hereby directed to cause this Ordinance and said warning siren easement to be recorded in the office of the Recorder of Deeds for Clay County, Missouri.
